    Hi there

    I've just been on the CCCS website and filled in the debt remedy questionnaire but because I'm self employed it says I have to call - excuse my ignorance - but why is that?

    We have just done our first appointment with CCCS and my husbands self employed. I believe it's because you can't give a set income. Unlike if you were PAYE. So much more to take into account and they will help you get a true and more realistic income figure. Which is important, as you don't want to be in a situation where you think you have more money spare to pay creditors. When in fact you haven't. Do give them a call as I was shocked when we looked into it and found that what earnings we were seeing and the banks were using were very different to reality. Now we know one reason why we are in this mess.

    Edited today (28.01.09 at 18.50hrs): No response from my fax but there was a letter when I got home from their Retail Collections Service which did not answer my letter of 6th Jan. I got a response that started with, "Thank you for your recent correspondence requesting a summary of our reduced payment arrangement policy".

    Firstly, I did not ask for that, I made an offer and asked them if they would extend the arrangement for a further year. Instead I got legal jargon about informal and formal arrangements which confused me further. In the end, I rang the number and was told by the person on the phone that I should have been contacted 6 months ago to request another financial statement etc and he further told me that once I sent this then I would be put on to a 3-monthly review but it would take a couple of weeks from them receiving my statement to sort out.

    I have had NO correspondence whatsover from HBOS apart from my monthly statements.

    I don't know how I am going to sleep tonight, let alone the next few months. I have been pacing the floor since I got home and feel like a rat in a maze.

    Sorry, I meant to edit my post rather than respond to my own. I guess that shows my state of mind at the moment. I am sitting here in tears and don't know how I am going to get through. I see posts here about Full and Final settlements and I wonder if my family could come up with the cash now rather than next year to help me, if it would be worth my while asking them to accept 50% of the balances?
    I have had a DMP with CCCS for just over 2 years. I also have a debt with HBOS Visa and like you I had 1 year interest free. however for the past year I have been paying interest and late payment fee's I now owe almost as much as i did a year ago. Every week I recieve phone calls from them asking for payment and also suggesting that I may be able to "get money from somewhere".
    whenever I contact CCCS they say they will eventually pass this on to a debt collection agency: WHEN!!!!!!

    I stated out on December 2007 with a £44,000 and have now reduced it to £23,000, I am getting there but it is causing huge worry and concern

    Thanks for your response Ela. I took my letter to my boss yesterday and she unravelled the legal jargon for me. What they said, in effect, was "no". I rang the Retails Collection Service who told me to send an up to date financial statement so I asked for a fax number and they guy told me that I would receive a call to say they had received the fax but wouldnt get it sorted for a couple of weeks as they had a lot to deal with. I sent the fax and waited all morning for a response which never came. I then spent an hour on my work phone getting passed to no less than FIVE operators who all transferred me to different menu-driven operators until finally I rang their head office in tears and got a lovely lady on the phone to spoke to them for me. They told her that it would be next TUESDAY at the earliest before they had even looked at my fax to acknowlege it but have given me a month's extention until THEY get sorted out. This is totally unacceptable but there is nothing I can do about it. I am seriously thinking about taking this to my local MP. No wonder banks are in trouble. They have become totally inept.
    :j Got the loan and now down from £9k to £4.5k. Trying to get a better mortgage deal now but thanks to ex-husband I am being knocked back..... Still in a better place than two years ago. Have faith!:j

    Keep your chin up: you will get there and try and develop a little hard shell, it does help, after all you are trying to be responsible attemting to get your situation sorted. Good luck

  • Hi, would really appreciate any guidance.

    A very pushy DCA have stated they will not accept even a written financial statement without it being confirmed/ratified by the CCCS.
    I offered a £120 payment yesterday but they insist that without a CCCS confirmed income & expenditure statement they will still require another £500 next week?
    Is that normal? Can they do that?

    My concern with the I&E statement is that I am self employed and will find it very difficult to prove a regular sustainable income stream (although really who can at the guarantee that at the moment).

    As you can see things seem to be coming to a head/impasse so I'm considering requesting CCAs but am not sure if it will make things worse, especially if they can supply in time?

    The earliest I can post them is Monday after the school run, before I do so is there any reason I shouldn't or alternative you would suggest i.e SOA?
    (Also, Registered or Spec.Delivery for each?)

    ANY advice urgently needed, I need to decide a course of action before Monday. I'll be working all day today and tomorrow until late and checking for any replies.

    If I enter a DMP/IVA - can the defaulted bank/credit card company take money from my wifes separate bank account if we are with both with the same bank.
    (These are totally separate accounts and not and never have been joint accounts but the address is the same)
    ie. Both Nationwide current accounts - my nationwide current & credit card will go into default - can they take from wifes Nationwide account ...

  • We have managed to get into financial difficulty and have been advised by out bank to contact a company called Pay Plan. They have recommened a debt management plan which they say is a free service. They will contact our creditors and agree a plan which will allow us to pay back what we can afford, from what I can work out this is a precursor to an IVA. My questions are Do you know if they are really free and do you think this is a good route to take.? Many thanks
