Can I claim for Mecanical Failure?
Comments
-
Is this OK??
Just straight to the point?
=====================================
To whom it may concern,
On [date], I bought a crank shaft pulley (Part:xxxx) from yourselves through EBay (Transaction No:xxx).
I am disappointed because the pulley failed causing over £800 worth of damage to my car. I spoke to someone in your company who admitted that they have had ‘issues’ with this part previously and very kindly sent me a new pulley made entirely of metal rather than the half-metal, half-rubber one which failed.
Due to these comments and the fact that a new part was sent out, I am confident that you have been negligent and are thus liable for the full amount of repairs to my car, caused by the failure of your part.
To resolve the problem I require you to reimburse me fully for all the repairs whilst reserving my right to claim against you. Enclosed is a copy of the receipt, and garage report.
I look forward to hearing from you and to a resolution of this problem. I will wait for 14 days before seeking help from my solicitor. Please contact me at the above address or email address.0 -
anyone?
Maybe there is another section for it to go in?? A Legal section or something?0 -
Peter, maybe its just too difficult to read... with all that [FONT stuff.. You have to try and make it easy for people to help you.0

SAD FART.......
anything sold must be
of Satisfactory quality
As Described
Fit for purpose
And last for a
Reasonable Time....
If any of these are not true, you have a claim.... and if the failure of a part leads to other damage you may have a claim.. best talk to a lawyer....0 -
Easier to read... I'd rather just send an email/letter before instructing a solicitor....

Don't muck about with a solicitor, see:
http://www.hmcourts-service.gov.uk/onlineservices/mcol/index.htm0 -
I sent the email and then got this back:
Hi Peter you need to send the parts to us that are damaged and the faulty pulley so it can be checked to make sure that it did cause this damage and if it has, we will then put it to the manufacturer to compensate you for any losses.
But I don't have the damaged parts... only the faulty pulley, but surely the report from the garage is enough?
Whats should I do?0 -
anyone any ideas?0

Spoke to the garage, they have binned the old parts....
What should i reply to them?0 -
Hmmm. The main dealer's £130 is starting to look a bargain.0
