Debt company

Hi everyone wonderig if anyone can help. I was on holiday and when i got back i had some messages on my phone from a company called mckenzie hall and then they rang me the other day saying they were a debt collections company and they had bought some debt i had from 2004 which as far as i am aware i do not have any debt from then. They have my old address so i refused to give them my new address as we have moved in the last month but our phone number stayed the same. I asked them to send me a copy of the signed credit agreement which he said they do not have as it was so long ago. Then he said he would send proof of it and asked for my address i told him to send it to my old address as i know the person whi has moved in and they will forward it on to me and he got quite nasty on the phone with me. So i just told him to send it out and I will look at it still have not recieved anything and when i got in from work last night i had another message on my phone from them. Where do i stand as he says they will just take me to court. I dont really have any debt apart from a tiny amount on a credit card. My partner has plenty think thats why i dont have any like to steer clear of it as he is on a dmp with cccs for all the debt he has from before we met. Sorry its long just worried about this

    McKenzie Hall are well known to us and they will get quite nasty given half a chance... they will also lie, threaten and use any nasty trick in the book... so... first point is to refuse to deal with them on the phone.
    You are SURE that you have no debt from 2004 or anything that might meet the description they have given you?
    If so then more than likely they are looking for someone with a similar name to you OR someone else who lived at that address near that time OR someone who used your name (rare) OR they're on a big time fishing trip...
    If they take you to court they have to prove you owe the debt so that's more of their usual tactics :)
    Someone will be along in a sec with the set letters you can send them to make them go away until they can prove the debt is yours - unfortunately I lost all my links recently but I'm sure someone else has them to hand ;)

    Account no:

    You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

    I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

    I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

    I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
