I wonder if we could add to this and make it a sticky as lots of people don't know the rules, especially with the new IB replacement benefit.


Disabled Person's Tax Credits
* Available to those working 16 hours a week, getting DLA (any rate) and with a disability which means that working full time isn't possible.
* For workers earning up to approx £17k (will check figure)
* Also is a passport benefit for free prescriptions etc

    Great idea, I know a lot is covered in the Benefits board but it will be easier to just come here.

    When we set this board up, Martin did say that he didn't want a lot of overlap with the other boards - I do wonder if the benefits board might be the best place for this, as that's the first place people go for benefits advice, and putting it here might mean some people miss it altogether?

    I happy to be out-voted on this though :D

    Didn't mean to overlap, I post there too, just to make sure people know their entitlement without getting hounded (as sometimes occurs over there)

    The only people i`ve seen hounded "over there" have been trolls who have set out to cause bad feeling,99% of people who ask for benefits advice on the benefits forum get exactly that,and to avoid confusion and duplication I personally think thats where it should stay

    Incapacity benefit will be replaced in Oct 08 with Employment & support allowance.
    New assessment for limited capability for work, & more capability ie work foccused health assessments & work related activity.
    Either contribution based or income based.
    it is expected 50 % of those who apply will be turned down & that of those accepted 90% will be in work related acftivity.

    Its worth noting that this is for NEW claimants ONLY,existing I/B claimants will eventually at some date in the future,probably after 2010,be moved to ESA,but probably with protected rights to ensure they are not worse off.
    Its also worth considering that these plans will be thrown into utter chaos with the decision by civil servants to take strike action in the coming weeks

    When you say this is for people working 16 hours a week and unable to work full time - I recieved this, worked 35 hours a week and was full time? Just wanted to clear this up incase anyone didnt think they qualified -

    I got this information from the HRMC Website:

    "If you have a disability and usually work 16 hours or more a week, you may be able to get extra tax credits.

    To qualify, you have to meet all of these conditions:
    • you must usually work for 16 hours or more a week
    • you must have a disability that makes it hard for you to get a job
    • you must be receiving, or have recently received, a qualifying sickness or disability-related benefit "

  • I think its great that this has been posted here and thank you soooo much for doing so as the information here is more straight forward and less confusing.. I have a question though..I am registered disabled, have a blue badge and on the lower rate DLA...I am soon to start part time work which will be within the 16 hours allowed, but to get disabled persons tax credit is the income of a partner taken into account when they are assessing ones claim? I have been told it is but as DLA is not means tested is that really the case?

    i think the best thing you can do is just submit all your information for the claim and see what it works out as - the DLA has no affect whatsoever other than "qualifying" you for the tax credits. All the tax credits do in effect is ensure you are receiving a wage to live on (thats my pesonal view of it)

    For family/child working tax credit yes partners income counts but as the disabled element is more "one person" im not sure if it would actually apply - its to ensure YOUR wages are meeting standard or your getting extra to help?

    Hope that makes sense - its my personal interpretation of it!
