Tax credits

can anyone advise. sidter has reently split up from hubby ( well 9 month ago) he has moved out and she is living in th family home with 2 kids. She has claimed for wtc and ctc. she is on sick leave with depression at the minute after the breakup but they have 2 rental properties that they rent out and have done for 2-3 years. They are both in her name as he did not want to declare them on his tax form. Is she entited to tax credits or not ? she says tax credits are not income based ? i not sure as hubby and i both woirk and get the low amount of £10 ish pw

Tax credits ARE income based. She will need to declare the income from the properties - if they are in her name why not sell them or at least sign one over to the partner?0
