    The problems all stem from the mislaying of the P45... did you keep your copy of it.. if so can you not give them a copy.

    when did you fill in the P46?

    I didnt keep anything. on the day I started I gave the p45 to my manager.
    once I'd had 4 payslips all at BR code, I asked my current manager what to do and he printed a p46 for me to fill in approx just after I got julys pay.

  • I know it's frustrating, but it will all be sorted out once your tax code is changed i.e. to remove the M1 suffix.

    PAYE income tax works on a "cumulative" basis. Once the M1 is removed, your payroll will calculate your tax as follows:-

    Look at gross pay to date this tax year
    Look at the income tax that should have been paid, on the correct code, this tax year
    Look at the actual income tax that as been paid, this tax year
    Make an adjustment - either deduct or refund - to the tax paid to date so it's equal to the tax that should have been paid to date.

    It happens immediately and automatically. In fact, it will simply be done within the payroll system and won't need "a person" to intervene - other than to change your tax code on the system.

    So the key to this is .... GET HMRC to issue a correct Notice of Coding. Your employer can't do anything without this.

    The P45 has a copy for the employee (Part 1A) which they should detach and keep and if this is given in with the rest of the P45 the employer should return it to the employee.
    But this is only for their records it cannot be used as a replacement P45 for a new employer, nor can a photocopy of parts 2&3 be used as a replacement, you can only use the original form.
    The employer should send in a P46 if required by the first pay day.

    the guy who hired me who has now moved to another store assured me that my p45 was sent to HR services along with my personal and account details when I started.

    HR say they have no record of it but have my P46.
    they say "it'll sort itself out and then you'll score for whats due back to you"

    It will sort itself out - once HMRC issue a new Notice of Coding - see my post number 14

    The P46 is the form that will sort it. As advised earlier you can ring the tax office to check if they now have it, they may be able to give you some idea how long it will take. Whether ringing them will speed it up I have no idea.

    Phone the tax office that deals with your employer. You will need your employers PAYE reference (sometimes called employer reference or tax office and reference). The first 3 digits in that ref tell you which tax office you deal with and you can get the telephone number at http://search2.hmrc.gov.uk/kbroker/hmrc/locator/locator.jsp?type=1

    You will need your start date/staff number & job title. Tell them you are suffering hardship and they will update your record over the phone & get a revised code out (removing the W1/M1 status)
