Horrible Letter

Just had a horrible letter from my BS. Clearly not the department that I am talking to about vol repossession - I have flat which I vacated in expectation of a sale before going BR, and which hasn't sold. It is currently empty.

The BS have received a letter about ground rent and service charges from a solicitor, who are threatening to take me to court - first I've heard of it. I have spoken to the maintenance company ages ago and to the OR about these charges before and have exchange of emails with the company.

The OR said that the charges would be added to the expenses of the sale of the property.

The BS have said that if they do not hear from me within 14 days the £394 will be added to the mortgage account with an admin fee of £225.

The maintenance and ground rent fees became due a couple of weeks after BR. I had included the ground rent of £25 on the SOA because the bill had come in but not the maintenance as not yet received. Its the same company operating under different names.

Its scary to get another threatening letter. Am I likely to have to pay this if the property doesn't fetch the mortgage price. I know a shortfall will go into the bankruptcy as an unsecured loan, but is this different?

Help please - thought I had got over the jitters - but am not so strong as I think!

    To be honest GettingHopeful, I'd just let them add it to the mortgage, thank them very much, and let the OR thrash it out with them.

    Which ever way you look at it the charges will get included in your BR, whether they're added to the mortgage or the maintenance company become one of your creditors, either way, it's not your problem and they can't take you to court over it.

  • Thanks Peachy. What was worrying me was that the bill is actually post-br - same problem as this council tax thing - sooner I get vol repos on the way the better! Am waiting for the legal advice the BS insist I get before taking that to next stage.

    Jitters gone down a bit, thanks, its not the end of the world after all.
