apparently because it's up to the decision maker whether or not they read reports at the form stage and mine decided no. Apparently it will take a full blown appeal to get the decison not to read my doctors letters over turned - how mad is that?

    Hi Glaswjn,

If you can obtain GP and consultants letters confirming your care needs send it to the DWP with a GL24 appeal form as they can change the original decision before your case gets to the tribunal stage, if you cannot ask them to write to them saying they are aware of your care needs. The more evidence you have the more likely the decision will be overturned before the pressures of a tribunal. Have your circumstances changed since your last award if not mention it in your appeal letter.
Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.

no not at all, the treatment has changed but it's not helped any. I've managed to get back to work though so i think they're assuming that because i work i'm putting it on a bit but i'm in a supported environment.

well CAB tried but they can't help me due to not having enough staff to cover their caseload at present. The lady did give me the GL24 form and explained that i had to quote the letter and write why i disagreed with each point.
  • It's always worth appealing against a decision. Before going to appeal, you can ask them to reconsider their decision, this can be done over the telephone or by letter. I generally ask for a reconsideration first, then go to appeal. Remember, the people who make these decisions are not medically qualified so things really do have to be spelt out to them. Good luck!

i called the 08457 number and asked for them to reconsider and they said that they will. the man asked me more about my condition and even he seemed surprised that i was knocked back. I'm going to print off the relevant bits of the decision makers guide and fill in the appeal thing with that in front of me so that i can refer to the right times. What's the chances that i wont need to use my appeal form?

If you go straight to appeal it goes for a reconsideration as part of the process, its also worth noting that if prior to going for appeal you ask for a "statement of reasons" then you have 6 weeks in which to appeal not the usual 4
