£104 For Failed Cheque

This makes me mad - I wrote a cheque out some time ago and the cheque was cashed this week and I did not have enough in the account...

This led to a fee of £38 :mad:

£38 for a failed cheque!!!!!!!???????????

Not only this but apparently they tried to pay the cheque in twice ...?? Is this even allowed?

And to top it off the charge that was applied pushed me to be overdrawn which caused a further charge of £28

Are these fees legal/justified? Can a cheque be paid twice and a bounced cheque fee be applied twice?

This makes me so MAD

    had the same kind of situation.

    mortgage is with halifax. current account is with halifax.

    told mortgage dept i will be paying by the 17th. the direct debit was taken out anywya. occured 38quid charge for going over my overdraft, 28 for them paying it and nearly recieved a £40 for not paying my mortgage.

    not the same. you are contractually obliged to make payment on your mortgage by a certain date. this is not flexible, and you don't decide when and if a (automated) direct debit should or should not be paid!
  • I do beleive that drawing a cheque with not enough funds in a/c to cover it is illegal, btw!

    could ask bank to reconsider charges, ivo delay in debiting, and also no contact made / notice given, to justify such high charges..?

  • If a cheque bounces , the bank will normally represent it , if it bounces a 2nd time its gets a refer to drawer ., hence the 2 separate charges .

    The only way to keep tabs on cheques you have written out is to keep a balance of your account written down after all cheques have been written , i.e a cashflow forecast and to check your bank account everyday
  • some days i am glad i have bad credit, and just a cashcard- cannot go o/d, so no fees!

    The answer is yes they can. A cheque is valid for 6 full calender months from the date of issue.
    I think you need to read Martin's guide to reclaiming charges.
