No doesn't matter at all. It is still you.
Give your local County Court a ring any way and find out what sort of wait they have at the moment ie if you were to book today then would the appointment be 3 weeks away? Then when you have the appointment with CCCS you know whether it will be worth ringing up straight a way to get the appointment or leaving it.
Also ask how many copies of the SOA they want. Some want 1, some want 3.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -
Thank you.
Letters all done so will post tomorrow. How soon am I likely to be bombarded with phone calls/letters, one cc is due to be paid next week and the rest at the end of the month. This is the bit I am dreading as have never missed a payment yet. What do I do with the letters? Do I need to keep them all?
Thanks again.0 -
I would keep them all, and once BC is declared send them to the OR when he requests them.
remember that when they phone, to tell them to stop harrassing you and communicate in writing or you will report them."Well, that sounds like a pretty good deal. But I think I got a better one. How about I give you the finger, and you give me my phone call"

Thank you will do. Hate talking on the phone anyway usually get hubby to make any phone calls (although quite happy talking to friends!!!)
Am also worried about the car, I know no-one can give me a definitive answer. I work about 30 miles away from home so 60 miles a day and need a car, OH doesn't drive, and we live a good half hour walk from anywhere, which I currently can't do due to a back problem. Car is on HP with about 10-11 months left, probably a similar amount to pay as it is worth (about 2.5-3k), is there any chance of me keeping it do you think? Would I be able to carry on payments? I am up to date and am going to keep on paying it.
Thank you0 -
If its on HP the OR wont have an interest in it as its not an asset as you dont own it until the last payment is made. Check your HP agreement for a Bankruptcy clause as the HP company may reposesses due to your BC. They would prob accept your expenses for Tax insurance fuel ect if theres no decent public transport in your area."Well, that sounds like a pretty good deal. But I think I got a better one. Thanks. There is no public transport that would get me to work but have checked the agreement and there is a clause about bankruptcy that the agreement will end. So looks like I will just have to wait and see.

Well if/when they take it, any shortfall will be included in BC (as long as you dont sign to say you will be liable for any said shortfall).
You will have to sort out a cheap run around im afraid."Well, that sounds like a pretty good deal. But I think I got a better one. How about I give you the finger, and you give me my phone call"

Though I seem to remember someone who had a BR clause in their contract and had only a few payments to make, who rang the HP company and put a hypothetical question to them and was told as they had nearly finished paying they wouldn't reposess. So it might be worth sounding them out and seeing.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

I sounded out OH's finance co re the HP on the car (OH will be going BR shortly), and they said they would be open to negotiation if someone was willing to pay more than they would get for the car at auction. So the current financial climate is quite useful in that respect! Apparently cars are going really cheap at auction at the mo, cos no-one's buying! It's definitely worth your while checking with the Finance Co - I just asked a general hypothetical question, didn't give any actual details
. Maybe someone could buy it off them for you and gift it back to you?
Hope that helps a bit. CBx
