Disecting your original post, it appears that neither EA put the buyer in touch with you.
You don't have an agreement with his EA, so you don't owe them anything, and the buyer got in touch with you to buy your house, knowing that you were selling yours! Unless you were both using the original EA for your sales, then I can't see that you owe any money to either EA.
If the info you posted at post #7, relates to the original EA, then they didn't introduce you to the buyer.
If it relates to the new EA, then the same applies as he already knew of you before they got involved.I am a Mortgage Consultant and don't like to be told what I can and can't put in a signature so long as it's legal and truthful.0 -
We did a chain break and made absolutely clear to the sellers that we had found them through the sellers of the house they were buying, that the price we were agreeing reflected the fact that there was no estate agent involved and that they should make this very clear to their EA.
All agents in our area have "sole agent" agreements rather than "sole selling rights".
If an EA is looking for money, he could ask for a cut from an EA of a house further up the chain; after all, without the chain breaker all the house sales in the chain fail and no EA gets any money.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Although I full on agree with you, the problem that I have is that the buyer name (at the top of the chain) is on the list of introduced buyers when the EA send him details of the house.
How can I get around that?0 -
One question, what sort of house is the chain buyer buying to live in himself and what sort of house is he buying to chain break?
I would expect that a "normal" chain would have say the buyer of a 4bed detached 400k house at one end and a studio flat 80k at the other. If this is true an EA would have to show himself to either be an idiot or a liar to claim that he sent details of the smaller property to the buyer of the large house!I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
