  • whilst it can happen, the assets of a liquidated company must be available for sale/disposal by the appointed IP in the case who will distribute funds amongst creditors after they and HMG get paid

    any mispractice can lead ti investigation by the OR's office, its rarely a OR that is appointed, usually a IP and they will hold a creditors meeting when directors have to take the stage and explain what went wrong
    Now we all know how it felt to play in the band on the Titanic...

    Employees come first (so outstanding wags, holiday pay, etc are paid), but others no longer have preferential treatment, this was changed with the Enterprise Act 2002 which came into force a few years ago.

    The OR is unlikely to get involved in the selling of the assets on HP, but they will have to tell the companies involved and act if said companies make a complaint will investigate further.
