whilst it can happen, the assets of a liquidated company must be available for sale/disposal by the appointed IP in the case who will distribute funds amongst creditors after they and HMG get paid
any mispractice can lead ti investigation by the OR's office, its rarely a OR that is appointed, usually a IP and they will hold a creditors meeting when directors have to take the stage and explain what went wrong0 -
Apparently me, the bank and tax man come first. If I have understood correctly I have to file for liquidation of the company as it has BR me personally.
Employees come first (so outstanding wags, holiday pay, etc are paid), but others no longer have preferential treatment, this was changed with the Enterprise Act 2002 which came into force a few years ago.
The OR is unlikely to get involved in the selling of the assets on HP, but they will have to tell the companies involved and act if said companies make a complaint will investigate further.0 -
The company owes me at least 40 k so I will be able to take all of the assets/equipment, but I don't suppose this includes facial equipment or TV as on lease purchase? and sell/ transfer them to the new company before I resign company.
