cccs never suggested bankruptcy to me either. they did mention an iva but as i don't have enough monthly disposable income, that didn't happen. So i would like to know if could still self declare too?

    Hi Deedee

Yes I've spoken to CCCs but BR was never suggested. You mention the judge will ask about this. What happens if the charity recommends a DMP over many years, can we still go ahead and self declare?

Yes you can. You have taken advice whether or you take that advice is up to you as long as you fully understand the implications of bankruptcy.

I spend £10 a week on the lottery and it was never even mentioned so don't worry. If you win big time then the OR is going to be a very happy man

  • Me too.

one more question Deedee if you dont mind. Most of the OH's debts are from last year but some are from this year, will that make a difference for going BR?

I think it was you that mentioned about the spending addiction being addressed, well thats well in hand, we're just waiting for an update from the doctor.

You need to add all benefits you receive in YOUR name into this, you have kids are you getting CTC and WTC or not, not sure on so few hours you get any at all. Child Benefit has to be included as well I think, any other income, but not your partners I dont think, although my brain is telling me I could be wrong on that count.

No it won't make any difference at all. Just be aware that she may get a BRO but that shouldn't worry her to much and may help her in the long run.

    How is MrsL?

  • Its hard to tell hows she's doing to be honest as she's denied to herself that anythings amis for such a very long time! I ask, and we're discussing it daily but It's me thats doing EVERYTHING to sort this mess out. I think until she starts counciling, or whatever the doctor suggests, then she'll continue to deny the problem but I'm keeping a positive mind that it will be very soon.

I've breifly talked to her tonight about going BR and she wasn't too keen on it. When I got to the bottom of why not its mainly because of what people would think and all the usual stigma of being a bankrupt.

Having looked at our future (not litteraly of course, im not a witch!) and all the pro's & cons I think I've convinced myself that BR is the best way forward. I'll have to show MrsL the facts and figures etc over the next few days and make a final decision as to which wway we'll go by the weekend.
I'm also going to talk to National debt helpline tomorrow.

Please give her a hug from me and tell her I wish her all the best.

Say to her that if she wants to come on here and talk us we will answer any worries she may have and none of the regulars will judge her.

When you talk to NDL make sure she is sitting next to you, maybe get her to write down a couple of questions that she wants answers too and you can ask them. If you can get her to talk to them all the better. The sooner that you can get her to 'own' this debt the quicker she will start to recover.

MrsL if you read this, please look after yourself.
