    The Agent was too busy to talk???? He must be kidding, they are sitting in our local one making paper planes. Something is rotten about this.

    our small town of 10.000 is well known for only having estate agents 5, take aways 10 and nail bars 3. well since the credit crunch 2 estate agents have shut up shop, my heart bleeds. we have loked at several properties in the last couple of years, and not on agent was on time, or bothered turning up. well they had the good times and treated us all like winnie, now its hard they are phoning offering stuff they are so desperate.

  • bill the seller for your survey fes etc, unless they exchange/complete with a reasonable time.

    thinking on, this sould be a scam by e/a's, to drum up income - get people to make out they are selling houses, ands split any survey fees.
    Long time away from MSE, been dealing real life stuff..

  • Too busy to talk??? What an outrageous statement.

    If you do nothing else, ensure you tell all your family and friends in the area to go nowhere near the agent if they want to sell. As an agent, he or she should be prepared to be honest and answer any questions there and then. It is a way to gain respect. This agent deserves none.
  • There's definitely something odd going on with this transaction. I'd get an appointment to view the house again - and have a frank conversation with the vendor and leave the estate agent out of it. Sometimes they can make things worse.

    Make it clear to the vendor that you won't be waiting around for them as your mortgage offer is only viable for a certain amount of time and you've spent X amount already and stand to lose it all. If they're reasonable people then hopefully they'll think again. If not - it's just one of those things I'm afraid - although whether or not you tell them you're walking away or not is up to you. I suspect they'll find out from their solicitor within a week or two anyway.

    Just wondering if you might have a strong case for insisting the estate agent pay your solicitors costs for this if you have to pull out.

    There are strict laws about the misrepresentation of property - what they are allowed to put into details etc. It would seem to me that if you have incurred expense due to an agent failing to tell you that a house is not actually available for immediate purchase, then that is misrepresentation, isn't it?

    If the agent knew, it would be misrepresentation. But this may be one of those situations where the vendor is up to no good and letting the agent take the blame.

    Hmm, my feeling would be that it is still misrepresentation whether or not the agent did it on purpose and the buyer would still have a case to claim against the estate agent.

    If it is something where the vendor has kept it secret from the agent as well, then it would be up to the agent to sort that out with the vendor.

    It would be pretty much impossible to take it further unless the EA signed something.

    It might be worth calling the NAEA if the EA is registered with them but on the whole, I think it'll be a waste of time and energy.

    You can buy insurance in case a house purchase falls through - I know it's a bit late now but something to remember when making your next purchase. Unfortunately lots of purchases/sales go wrong and in England and Wales, there's absolutely no comeback at all unless you've exchanged contracts already. It's different in Scotland - as soon as you've made/accepted an offer, agreed on an entry date and signed the contract, you've exchanged contracts. This happens within a couple of weeks of the transaction being agreed. I'd like to see that being introduced all over Britain, it would save an awful lot of people a lot of money.

    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
