Help!!!!

I got home to this letter today and am very confused as to what to do:
We are in receipt of your request for a copy of the executed credit agreement in accordance with Section 77(1) and/or 78(1)of the consumer credit act 1974

The account agreement to which you seek is not a regulated agreement under the CCA 1974 and th provisions of this Act do not apply to this debt.

Our client therefore has no obligation under the provisions of the Act to supply the information requested by you.

Please phone to discuss settlement of this account.
It is from Red DCA and is regarding an old T mobile account.

Please help as i dont know what to do next.

Many thanks

It's true that there's no cca for mobile contracts, where to go next I don't know, I suppose negotiating a payment plan.
Unless I say otherwise 'you' means the general you not you specifically.

when is the debt from, do you know. If it over 6 years ago it is statute barred and you dont have to pay it.

  • debt is approximately 3 years old...i had a letter from them sent back in june, sent to my old address, that i picked up offering me a settlement figure of £130ish if i paid by 22nd august. Do you think they would accept an offer of the same amount?

you can always try. Do you actually remember the debt.

Try pleading poverty, start offering at £90 and then go up in £5 stages
you never know, it might work. let us know how you get on wont you.

Have a search on the forum for airtime agreements. Before they can collect a debt, they frist need to prove that one exists. Are you sure this is your debt, or could they be asking you to pay someone elses?

It's true that an airtime agreement doesn't require a CCA (i thought it did originally), but they still need to provide proof that the debt exists and that it is yours. Have they provided proof or a copy of the airtime agreement?
