DCA saying they can enforce debt without a CCA?

If we don't hear from you, if you don't respond now, one of the following options will occur:
    Warrant of execution with Bailiffs
    Charging Order
    Order to obtain information
    External debt collection agency or Legal Agency calling on you

    I suggest you do not respond immediately. I suggest you ring the OFT tomorrow and lodge a formal complaint. The OFt may want a copy of this latest letter.

    let us know how you get on.

    Unless of course they said may rather than will, although I would still ring the OFt because this is now haressment.

  • Thank you RAS. Do you know if I need to send a letter to Cabot explaining that I am lodging a complaint with the OFT? Also, is there a template letter for writing to the OFT?
    Sorry for all the questions, and thanks again for all your help!

    Hi again everyone, this is still on-going. They seem to have passed this debt to another DCA called "FIRE Ltd" who have sent me a letter with the following: NOTIFICATION OF INSTRUCTION TO COLLECT Due to your failure to pay the above debt, FIRE have been instructed by our client, to recover the full outstanding balance on your account.
    -This notice is issued for non-payment of the above debt
    -Failure to pay your debt will result in further recovery action
    -PAYMENT IN FULL IS REQUIRED IMMEDIATELY
    You MUST now contact one of our agents in our Recovery Department on xxxx xxxx xxx.

    Can someone help me please?

    You may not need this but am posting it anyway.

    While reclaiming charges, a debt has been passed to a DCA while the debt is in dispute

    I would appreciate your due diligence in this matter.

    Letter today from Intrum Justitia "we will not be taking any further steps to recover the outstanding balance of £15850.24 and we trust the matter can now be considered closed" Yeeeeeeeeeeeeeeeeeeesssssssssssss!!
