Can estate agents do this?????

Hi,
Please be patient, this is my first post, but have looked at this site for many months.

Right - my problem is we have sold our house, we have put in an offer on another which was accepted, on condition it was taken of market (we are cash buyers) memorandum of sale was sent to us, we have solicitors working on sale etc. had a look on rightmove and house had been removed from our estate agents, only to find it had gone on with a completely new one, phoned my estate agent who denied knowing anything about it, but later that day found out he was lying, and he was the one who delivered the house keys to the new estate agent. (owners of house live abroad, so I cant speak to them about it) told my estate agent that he should speak to the owners and find out what is going on? apparently owner said he was just hedging his bets...............
Not happy with situation at all, this just leaves us with chance of being gazumped, and left to pay solicitors bills.:mad:
Any advice?

    It's a buyers market, tell the owner that you are withdrawing your offer and offering £10k less?

    Let him sweat a bit.

    If you REALLY want the place then you just have to suck it up.

    You're hardly going to get gazumped in the housing market as it is. You're right, EA's are lying slimy toads, the lot of them. Now you should gazunder them as you probably paid too much anyway

    Yes.

    If you still want it. why they moved EA - who knows? Have they put it on for more now?

    They may also have to pay commission to two EA if you buy it. But that's their problem not yours.

    No, because you are already dealing with the first lot of agents. The seller is being completely sensible not taking the property off the market. You should ask, however, for a lock-out agreement whereby if you proceed at the agreed price within a specific time they are bound to sell to you and not take higher offers.
    No reliance should be placed on the above! Absolutely none, do you hear?

    The new Estate Agent has put on the market "offers exceeding £xxxx" which was the original price of the original Estate Agent, i think the buyers are trying to see if they can get an offer above ours, in which case they will take the new offer.

  • I wouldn't mind, but surely there has to be a certain amount of faith in us being cash buyers, and solicitors already on the case, the owners know that, and why put it on with a new agent 3 days after they accepted our offer?
