  • Actually, thats a good question.... does anyone know what difference it would make say if there was found to be an old (over 6years old) CCJ sat on file? Can the debt still be made ''statute barred''?

    A CCJ is never statute barred, but you then need to request the CCA if it is a Cc, loan or catalogue. Unless they have that, they can do nothing.

  • im having probs with mackenzie hall i have been paying them for the last 27 months by standing order but now that has finished i got a phone call this week demanding more money the person was so abusive i hung up only for her to call back & abuse my husband.
  • You should report them to OFT (office of fair trading) that's just not on. How do these people sleep at night? They must be working on commission, surely?!

    I've finally had my reply arrive from Mackenzie Hall. They have confirmed what the debt is including the actual credit card number relating to the debt and they also state that i defaulted in Sept 1999!!! I have not made any payments towards this debt since then altho they do not acknowledge that in their letter. Which letter do you think i should send to them next.... the "Statute Barred" letter ...or a letter asking for a copy of the signed CCA first ????

    I would send the statute barred letter - it costs less. If there is a CCJ, they will com back and inform you - otherwise they should no longer pursue the debt.

    Right....sent my Statute Barred letter off on 20th Oct and it was signed for on the 23rd...BUT yesterday i got a "DOORSTOP ASSESSMENT" letter dated 22nd Oct stating that i have 72hrs to make payment or i'll have someone come a knocking!!! Now the statute barred letter that i sent obviously didn't arrive until after the Doorstep letter was sent but should i respond to this letter or just wait to see if the Statute Barred letter has the desired effect.
