Mackenzie Hall/Cabot Financial Final Demand - Next steps?

Hi
To cut a long story short in 1999 i got into debt -Barclaycard & Mastercard - to the tune of around £2000 and at the time could not deal with it. I lost my accomodation (rented) and ended up moving around a lot since then. I'm ashamed to say i walked away from my debts - i was just young, naive and thought i couldn't cope. Anyway - roll on 2 weeks ago - 8 years later - a letter addressed to the Occupier arrived from J2 Solutions asking if the occupier knew the whereabouts of "my name" !! I googled J2 and realised that they were a DCA. The next day a letter from J2 arrived this time addressed directly to me stating that having made 'enquiries' they were aware that i resided at this address! Having read the threads on here, i kept cool, calmed down a bit and decided to ride it out and see what happened next......well today i have now had a "Final Demand" from Mackenzie Hall trying to collect a debt of £2200 on behalf of Cabot Financial Europe.
So, i'm thinking that this must be in connection with my Barclaycard & RBS Mastercard debt after all this time!!!
What would you guys do next?
Surely this is 'Statute Barred' after all this time?
Should i send a standard letter to the effect of that i don't know what the heck they are on about and to send evidence of the debt they are trying to collect? And if so, which letter/template should i use?
Or, do i continue to ignore?

Be chuffed to hear what you guys think
thanks

hi and welcome i have to go out now but will be back later with details of how you deal with this . Main thing for now never ring them !
  • Hi there
Much like you I got into debt when my marriage broke up and i wasn't able to deal with things so just walked away
about 5 months ago, i received a letter to my current address from a DCA in middlesex chasing debt in my married name. i called them and told them that name wasn't known at this address.
i heard nothing until sept when the same debt was now being chased my mackenzie hall, still with cabot financial reference number - just increased by about 100 quid.
i also received a final demand. i called them and told them the same that - that a person with that name was not known at this address and had never lived here, as this is true.
today i have received a letter from J2 solutions ltd who are also part of mackenzie hall, but this time it was addressed The Occupier, but when I open it, it has my name, and it says that they're trying to contact me.
    What do I do now?
    Write statue barred?
I've read some things about J2 solutions and it's not nice - they've come round and spoken to neighbours etc and i certainly don't want that - what the hell do I do please?

Nessy, as I said never ring them . You should write back not confirming any details ,ONLY use their reference number . State you do not acknowledge any debt to their company and suggest they check their information . If you hear from them again with account details etc . then send a statue barred letter .

A debt is statute barred if you have made no payment towards the debt for 6 years (5 in Scotland), or acknowledged the debt in writing. If you believe the debt to be statute barred, there is a letter you can send them.

  • thanks for the replies guys it helps so much - you are all so positive and i'm really trying to stay positive too.
OK - so first thing i will do today is send them a letter, recorded delivery, saying that "i do not acknowledge any debt to their company and suggest they check their information" - i mean really thats spot-on, according to my 'records' i don't owe "Cabot Financial" (or Mackenzie Hall)- i owe Barclaycard and RBS Mastercard - crikey if that is what the debt is for - surely it can only be that!!!!

Whilst i am corresponding with them, can they take 'further action', whatever that may be, as they imply they will do in the letter?

Does anyone have a link to a copy of the letter i should send to them that i could use?
  • Forgot to say....i've had no contact with a DCA in the last 8 years and have made no payments.
  • ...me again! Does the letter where i do not acknowledge the debt thingymebob go to Cabot Financial Europe or Mackenzie Hall?

If you have a read through that (and the further links/factsheets) then most things should be clear.

Cabot/MH buy old defaulted debts that are frequently legally unenforceable, hoping that they can get people to pay up without them realising this.
