what the jiggery pokery are MBNA playing at sending me this letter....

    Hi pink i think a letter would be best stating that on receiving their email you will be in a position to accept their offer of 8xx. Could they confirm in writing that it will be a full and final settlement, that you credit file will be marked as satisfied and that ...(the rest of ths stuff from the F&F letter on NDL).

    I'd try to get them to confirm it in writing - you could enclose a copy of the email so they can see the figure they sent you.

    well just to give you an update on the what the muppeat mbna are doing!!had a rather strange and abrupt a/p msg left on my mob today to which i replied to at lunch, abrupt lady wasnt there so they said they would call back within the hour, no joy! called back and spoke to a really straight talking competant man whom i explained that i had, had very odd letter and phone calls and emails syaing different amounts etc. he basically said the letter i had recieved was rubbish and sometimes people dont seem to know what they are doing at mbna! he agreed the £800ish as settlement as this had now been sent in writing and it was their mistake so they would have to do it at that now! it wont be a f&F but a partial settlement but they would send a letter stating all of above and also that they would not be liable for any remainding amount and that they would not chase me or sell it on to anyone (or something like that-cant quite remember the wording!) So there it is i will await his letter- he did say to call him if i havent had it by the 20th! fingers crossed! Lets hope it arrives as that amount is about 30ish% of the debt!

    You don't want a partial settlement - that just means they may wait a few weeks before asking you for the remainder of the amount owed.

    george uk - ndl said a partial settlement was ok:confused: as long as they said they wouldn't pursue it etc ( they are sending me a letter which consists of the correct paragragh mbna need to put), so i am going if they say it's ok then it is?????agghhh! anyone else advise?

    true to his word the man at mbna has sent the following letter, very pleased as it says the lower amount too!

    please can anyone have a look over it and see if they think it is acceptable?

    i am just going to try calling cccs and ndl to double check the letter through with them aswell!do not want my fingers burnt!

    Confusion here

    Full and final settlement in the letter means that they will not pursue or assign the debt.

    partial settlement in a letter is just that and loads of people have been stung by companies taking settlement and coming back for th rest or selling on the debt.

    HOWEVER
    when it comes to your credit record, it is perfectly acceptable for a comapny that has accepted a full and final settlement for part of the value of the debt to mark this as "partial Settlement"

    You need to be clear what is being partially settled, the debt or the note on your credit record?

    Than run it back passed NDL if neccessary
    The person who has not made a mistake, has made nothing
