In 2005 we put a deposit down on a plasma tv with a company called 'Tiny' at a shop in Telford. The company went into administration soon after and we never got our tv or our £100 deposit back. We just wrote it off at the time. Now I am wondering if I would still be able to claim for this under section 75, any advice?

Can a Section 75 claim be refused due to the Credit Agreement being signed more than five years ago(In Scotland), claimed against the credit company as original supplier gone bust, goods mis-sold and mis-represented, and basically destined never to work(roof coatings), I have this posted under the PPI other section but there seems to be a bit more knowledge in here in regards to Sct75 of the CCA here, can anyone help shed any light on this please.
I think the credit company are just trying to get out of it, as I would think it is 5 years from the date of claim or complaint for court action, and for taking to FOS 6 months from date of final decision by credit company which they still haven't given me.Thanks to all the competition posters.0 -

I posted this in the Flight Delay Compensation pages but now think it would be better answered here so:
Hi there after a few months of on/off searching for any remains of my delayed flight back in 2009, I found a folder with copies of the boarding passes and credit card statement. We were delayed for over 24 hours due to a mechanical fault and also had to land at a different airport, That was why i remembered the flight becuase my car was parked at the original airport that i should have landed.
My problem is, is that the airline (Eurocypria) have been liquidated way back in 2010, I found out who their liquidators were but doubt they will be of any use 4 years down the line.
As i paid by credit card is section 75 a route i can go down? As the website i purchased the tickets no longer exist and i think their fate was tied to Eurocyprias'.
I also take it that if S.75 was an option i would only be able to claim the £450 back for the flights and not the £990 for compensation?
Since then i have re-read the Section 75 page on the MSE main site and even although i paid through a third party because the purchase was for tickets only that i why i believe i have a claim.0 -
Very good story, actually arguing a case with GE Money see previous posts on this thread and in the PPI section(other reclaiming part).
I'm going back to them again with a more detailed letter, again with sales material, they keep trying to say my alleged conversations aren't proof so I'm having to keep telling them I'm not alleging these things were spoken, I'm telling them that it was in sales material given to me, and another photocopy sent to them.
The last letter they told me that it was time barred, and I've had to explain to them that under Sct75 CCA there is NO time bar, and it should be from the time of finding out about the mis-sale and mis-representation, just the very same as if matters were time barred at 5 years in Scotland or 6 years in England and Wales most PPI claimants wouldn't have gotten any money back.
So I've asked them now either to find in my favour or give me their Final Decision so that I can take it to higher authorities, let's see how this goes now.Thanks to all the competition posters.0 -
Has anyone had any luck using this for a flight delay? I have been in contact with holiday watch who said if it was paid with on a credit card you can contact the card provider for assistance under section 75.
The problem is that we paid for it as a package holiday so im not sure how it would work. Does it only cover flights if they are cancelled rather than delayed? I have already gone down the path of the airline getting compensation through them however they are a very small company and absolutely useless. No office in the UK and no response from them since august! Any help welcome!0 -
Hi all. I had a website built for me which I paid £3000 on my credit card for. I cannot use the site and I cannot get a solicitor interested to bring a case against the company because the case isn't for a large enough sum of money.
Regarding section 75 - can I try and get the money back from the credit card provider without taking action against the website comapny itself? It seems a bit unfair really because it isnt the banks fault? But still - they take money from us so I might give it a shot? Im also considering taking the comapny to the small claims court but I need to look into this.
