    Hi Derrick,
    My partner has payed £500 to a LGV training company with his credit card just before xmas 2010, we have been waiting for a date for the course to start, they telephoned him just after xmas saying they would be intouch in next few days, this never happened, sfter countless emails and phone calls to them, we have had no reply, and have just found out through a LGV forum they have gone bust before xmas, after taking our card payment.

    Would we have a section 75 claim? any advice would be great please

    Sounds like you have to me, contact your CC company and inform them you wish to make a S75 claim, they should then send you out the forms to start the ball rolling.

    You will need some form of proof that they have gone bust, so contact the liquidators for this confirmation.

    Thankyou very much for getting back to me, would you know how im able to find who the liquidators are, or who the admins are??

    The only time I had to do this was a local company and the liquidators address was on the premises door.

    You could try Googling, and/or put the company on this thread and see if anyone else knows anything.

    The company is known by two names DIRECT LGV LTD and DRIVE LGV LTD, the money was payed to them, after checking cc statement, it shows the payment went to ORCUS DESIGN LTD, which is a web design company, i googled that, and the registered address for them (ORCUS) is the same as DRIVE LGV LTD who the driving course was booked with..??

    I am a little confused.... in Feb 2010 I paid in advance for airport parking for Dec 2010. However when I turned up on the day I learned that the company had just ceased trading. I contacted Amex and they told me that as the transaction took place more than 120 days ago there is nothing they can do.

    Is this right as I'm sure I have read that the 120 day limit starts from the time you become aware of the problem.

    Any advice would be appreciated.

    (the amount paid was £55).

  • The annual fee for my Health & Fitness Club is £385.
    I pay £385 by credit card.
    If the firm goes bust, for instance, after I have used 9 months, can I reclaim the full amount, or the 3 unused months, or am I unable to claim anything at all if the amount to be claimed is less than £100.

    You paid for a full years membership, if the firm goes bust then S75 should issue you with a pro rata refund, i.e. in your example 3 months, why would you think a full refund? You have had 9 months use!
    Your contract was for over £100, so S75 applies.

    Is this for real or hypothetical?

    Think that would be correct, it isn't over £100 so Section 75 protection wouldn't apply.
