Section 75 refunds - article discussion

    Just a quick question, does the section 75 include tax or exclude tax? So would an £80 exc VAT product come under a refund?

    Hello ,
    Quick question I booked a flight and hotel package from Lowcostholidays.(Flights are fine its the hotel worried about)
    I paid the deposit on one credit card and the rest on another one.
    I know after watching a few of Martin Lewis chats that if you paid a deposit on a credit card that company is liable for the amount of whatever as they should guarantee the end product.
    So my question is do I claim from both card companies?

    my elderly and disabled mother and father in law, brought a 3 seater and a 2 seater entertainment sofa from the range, not quite 2 yrs ago at just under 1k. It has split in several places on the seating and also on the arm of the entertainment unit. After contacting the range they sent Homeserve out who reported it as wear and tear. What utter codswallop. They are 2 elderly ppl, no grandkids, no pets jumping on it. They said it was `body heat`. We are now contacting their credit card company but the silly beggars have gone and paid another 1k out and are having a new one delivered Tues and they are taking the old suite away. What if they credit card ppl want to see the damage.

    They need to keep the sofa until any dispute is settled. At the moment they've provided no evidence of an inherent fault - no sofa and no report supporting their case is likely to lead to a claim being refused.
  • Hi parents have called Travel company on Sat yesterday and booked a trip to Torquay nearly 800 inds on visa.
    Ive came to see them looked it up on tripadvisor they are now in tears it awful. State of disrepair damp etc
    T&cs look like they will only get 30% of monkey paid back from them.
    Are they able to claim the full amount back from Visa under its protection if travel agent try to keep their money?
    All help greatly appreciated their health isn't great and really worried about this. Thank you

    I booked flights through an online company and oaid in full on my credit card - £750.

    The flights have been cancelled by the airline so I have had to ask the online website to process my refund - they will do this at a cost of £50 per ticket. this works out as £200!

    Has anyone ever came accross this and can I apply under section 75 to the credit card to cover the costs please?
  • Hi, this is the first time I've used this pg, please forgive if I do it wrong.

    My question is, is there a time scale which section 75 applied to???

    My situation is:- I paid a deposit on credit card for wedding photos then paid balance before wedding on credit card in total was around £1500. We only ever received a sample book of our photos and not the album we wanted. I have just found out the guy has gone into insolvency. So I contacted my credit card company but they said they only cover transactions which took place in the last 6 months. The transaction was in late 2011.

    I ordered some bathroom stuff about two months ago and haven't received it so I raised a dispute with my credit card provider.

    I was wondering if they also refund the interest charged on the amount of the sale, or if this is refunded as well? If it is not refunded I will clear the balance, but could otherwise do with the money in my current account.

  • I paid for my Hire & Reward Taxi Insurance to my Insurance Broker in 2 instalments both on Barclaycard Visa on 21/03 (£468.83) & 21/04 (£399.80). I have just been informed that the Insurance Company (Enterprise?) has gone into liquidation. I Have changed my vehicle and they are not doing any changes to policies so I'm going to have to get a complete new insurance. Does Section 75 cover this situation & do claim for unused part of the year or the whole payment? If I was not changing the car, any claim is covered by the Financial Services.

    Hello,

    Just wondering if Curry’s have screwed me over here, last Friday I purchased a laptop for £270 on a gift card. The laptop was delivered in store the next day and broke after about two hours. So took it back to store the next day and initially ordered a like for like replacement. I however changed my mind a couple of days later (partly due to delay in delivery) and went in store and purchased a slightly more expensive model for £300 and as such paid the extra on my Credit Card. Doing this gave me Section 75 rights too so I was happy enough.

    The laptop arrived Wednesday and within two hours broke on me (second laptop to break, not good…..). So I took it back to store to order a like for like replacement however the girl in store processed the initial refund to a gift card in its entirety as opposed to £270 to a gift card and £30 to credit card. She did this without my knowledge and only told me after she had ordered the replacement laptop. As a result of this I have now lost my Section 75 cover and I am not happy about it, do I have a case against Curry’s for this? Even Curry’s head office themselves have confirmed that this refund should have been done £270 gift card/£30 credit card and then the new order processed in the same manner.
