hi. i am posting late but my sister-in law has just telephoned me to ask me to go to court with her tomorrow morning. she has to attend because a local doorstep money lender who she has used for years on and off says that she owes money on a loan that she cannot remember taking out, as she believes that all of hers were paid up.
unfortunately she has not told anybody about it until now as she is very depressed and anxious and rarely even picks up the phone or answers the door to family.
please can anybody tell me what it is that i need to ask for from the lender ,to prove whether she actually took the loan out or not, so that i can tell the court that for the time being at least she is disputing the debt. i do not even know when the loan is supposed to have been taken out!
i know i am asking a lot , but she is in court at 10 am tomorrow and i am just trying to help her establish whether she actually took out this loan or not. i would be soooo grateful for your help. thankyou

I think she needs to ask for a copy of the customer credit agreement.
I actually think that she would need to have asked for it earlier, but if you tell the judge that you have sent a letter requesting a copy of the agreement with the £1 required payment then that may work.
As time is important here i would suggest that you or someone other than your sister write a cheque for £1 made payable to whoever is trying to collect the money and send this template letter. (she shouldn't send anything with her signature and it may be too late to get a postal order)

I'm sorry to hear about your SIL's troubles. I'm sure someone more knowledgeable than I am will be along soon to give some advice, but I couldn't just move on without replying.
Can you give us a rough idea where your SIL is? (Scottish law is different from England & Wales for example).
Also, do you have any more info about this debt? When she supposedlytook it out, when she last paid anything to it (supposedly), and so on. That might help people when they're giving advice.

hope you get to see this before you go; there will likely be someone from citizen's advice at the court - make sure you head straight for them, try to arrive at least half an hour early.
My neighbour had an issue with one of her loan collectors - who took out personal loans in my neighbours name, you never know... :eek:0
