Brand new ipod touch. Paying to update!?!

I got a brand new ipod touch when I was in the US, I've just taken it out of the box, and am trying to put all my stuff on it.
I downloaded some free apps, but now it's telling me that my software is out of date, and I need to pay £5.99 to upgrade!?
Is this right? Surely I shouldn't have to pay to upgrade on a brand new product!?

By the sounds of it you got the Ipod Touch with is pre version 2 software, to be able to install apps you need software V2, either pay the money or don't install the apps, The choice is yours0

Yes, the 2.1 firmware update costs £5.99 if you're upgrading from version 1 firmware.
If your iPod only has version 1 firmware, it sounds as though you've actually bought an older model.0 -

It may depend on when you bought your iPod.
Have you compared the release of the software update to when you bought your iPod. If the software update was released BEFORE you bought your iPod Apple may offer the upgrade for FREE as a gesture of good will.0 -

I bought it in August in the US.
Just called Customer Services in the US, and they told me that I have to pay for it, but it's not a necessary update if I don't want it.0 -

Apple have been selling iPod Touches with the version 2 firmware for the past 6 months or so.

Apple have been selling iPod Touches with the version 2 firmware for the past 6 months or so.
The latest update to the Touch was released at the beginning of September. It features hardware volume controls, a built-in speaker, and it's cheaper. If you're buying an Apple product, it's usually worthwhile looking at an Apple rumour site such as MacRumors or AppleInsider to see when the latest products are rumoured to be released. It's sometimes worth holding off for a few weeks.0 -

you've bought a V1 ipod touch, with software 2.0 on it...
in september, they released 2.1, so this is a chargeable update.

aaah well... if that is the case, then yes, upgrade, as you get the application store feature, and can install paid/free applications on it..
as v2 software came out in july, i assumed as you bought it in august, it would have had the v2 software on... 2.1 came out in september, and 2.1 is only free if you had already PAID for v2...0
