    Made a complaint re First credit and the breach of of OFT reccommended guidlines and got this today!

    Thank you for your email and attached documentations received on 1 June 2009.

    I am very sorry to hear about the difficulties you and your wife have been experiencing with the above mentioned traders, however the OFT has no authority to become involved in disputes between consumers and traders and so we cannot offer you any direct help with the complaint or advise you directly in this matter. Our role is to protect the collective interests of consumers.

    The above mentioned Act established a licensing system to protect the interests of consumers in the credit area. If a business wishes to undertake the collection of debts that arise from consumer credit agreements then the Act states that they are required to hold a consumer credit licence; this is issued by the OFT. The above traders hold consumer credit licences. Under the Act, the OFT has a duty to consider the fitness of all traders who hold consumer credit licences.
    In considering fitness we take into account whether a business has engaged in improper business practices. Where we receive complaints about the business practices of licensees, we investigate them and where appropriate we take enforcement action; that action depends on the evidence and circumstances. Action the OFT can take includes revoking, refusing or suspending a licence; or placing conduct requirements on the licence of the company or business in question (failure to comply with a conduct requirement can result in a financial penalty being levied).

    The OFT has issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance is intended to ensure that debt collectors treat debtors fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants.     I have noted the details of your complaint, and we will continue to monitor 1st Credit's compliance with both the Requirements and the Debt Collection Guidance. We are therefore interested in complaints that details issues which have arisen after the Requirements were imposed. We will consider these alongside any other complaints we receive and would therefore be grateful if you could sign the enclosed consent form and return it to us. Unfortunately, we cannot disclose any details about any action we may take, due to restrictions on the OFT relating to disclosure of information (Part 9 of the Enterprise Act 2002).

    We note that your email raises concern in regard to credit agreement.
    As you may know, s63 of the Act covers how and when lenders must provide consumers with a first (and where appropriate second) copy of a regulated agreement. It is clearly in the lender’s best interests to retain details of the original agreement and any subsequent variations or changes made to it, particularly as consumers can request a subsequent ‘true’ copy of most types of agreement under ss77 and 78 of the CCA (and on payment of the appropriate fee). There are rules about what is likely to constitute a ‘true copy’ under these sections of the Act. Further, if a consumer does make a valid request for a copy of their agreement under these provisions and the lender does not comply with the request the agreement may not be enforceable in the Courts, subject to any other mitigating factors.

    Should you require specialist advice or assistance on the circumstances of your complaint (including in relation to the above provisions about copy requirements), you may wish to contact your local Citizens' Advice Bureau or seek advice direct from a legal adviser.

    The Financial Ombudsman Service (FOS) can help with most complaints about consumer-credit products and services if the consumer has failed to satisfactorily resolve the matter directly with the financial institution itself.     Got my OFT response as previously posted , then 3 days later without even contacting 1st credit with regards to my complaint I got the following letter from the compliance officer . THEY READ THIS FORUM

    Whats my next move? Do I go ahead with the the OFT complaint?
    And has anyone got the email address for Mr Kindon AT first credit ?
    Please help as Im not sure what my next move should be.

    1st Credit are scum.

    They have been chasing me for well over a year sending out the same letter again and again, after I requested a CCA. They basically sent me ONE page of a Sky Card application form (doesn't say I have even been accepted!) and told me that is the CCA and if I don't pay immediately (they won't take offers) they will take me to court. I keep sending letter pointing out it's not the CCA (doesn't have prescribed terms blah blah) they just send it again.

    OFT were informed.

    Trading Standards looking into it.

    Financial Ombudsman are now dealing (and keeping 1st Credit at bay). Went to Financial Ombs two months ago; heard nothing since the initial - we are looking into it letter.

    Even if the F.O sides with them, I'll still tell them to send proper CCA as Trading Standards have said what they have sent ISN'T right! The way I see it - they would have sent me to court ages ago!

    Just to add my bit in....
    Already complained to OFT.
    Been 8 months and still no CCA. Complained to FOS, who also recommended Complaining about Citibank for selling my, alleged, debt on to this scum whilst it was being paid via CCCS.

    ANYONE who is having trouble with 1st Credit, download the Guidelines for Debt Collection from www.oft.gov and Complain to OFT and Financial Ombudsmans Service....we have to keep the ball rolling against this lot....we can get their Licence curtailed:D

    Hi I have just received a letter off these people asking me to call them... However, I know for a fact that I have no debt outstanding at my previous address. When I sold my property I paid everything off, and on my credit score it is all showing as settled! I have a couple of debts at my new address which I am paying ok every month, and either way they are registered at this address, not the previous one. I judge by their letter that it is in relation to my old address, although they give me no details. I intend to ignore this until they can provide evidence of what they are chasing me for.

    It is so scary when you read what people have gone through with this company. I have struggled with debt in the past and am finally getting my credit rating where I want it, I can't believe these people could come along and mess it up for something that I can only imagine is not a real debt!
    Am I doing the right thing ingnoring them?
