comet rip-off

Hi, please help.
I bought a DVD recorder 18 months ago from Comet. Since then, it has been replaced, repaired and is currently out of action again - all with the same fault. Comet say tough luck, I have to pay for another repair. I want a refund as I think I am legally entitled to this due to the number of problems I have had. Comet will not budge. Have wrote to head office without any luck.
Any ideas??:confused:

    i would have thought it reasonable to expect ajny electrical goods to last over 18 months , especially after the trouble you have been thru - go to trading standards
    if you have no luck , stand outside comet with a big banner

    Maybe there is consumer miss-use.

    Is there a common fault with this Model? If not I am looking at the OP mistreating the unit.

    It seems comet might be looking at the same thing, Everytime something of mine from comet has failed they fixed it (even one that was a day over the guarrentee)

    Comet can Repair or offer a partial refund if they wished as you have had use out if the item, they could issue a full refund if they wish but not legally bound to do so

    Why not contact the manufacture ask if they're aware of a common fault with this model.

    Failing that, obtain an independent report for the item, depending on the report if required issue a claim against Comet through the small claims court.

    Under the sale of goods act.......6 years.......reasonable....expect to last......onus on the retailer......

    If it has been in repair for a considerable amount of time then the item was nto fit for purpose. You have rights for a full refund and AND small compensation for your troubles. They are not obliged to compensate you but you are 100% liable for a refund, well according to alot of the posters on this webshight anway.
    What if its consumer missuse?

    Write to Comet H/O first before you do start filing court cases! If they won't offer what you want immediately they may ask you to (and they are legally entitled to) obtain an independant report to show that there is an inherent fault with the unit, for which if it is agreed they should foot the bill for it and offer you one of the options below. If you still do not agree THEN is the time to talk about small claims court.

    Be aware, however, under SOGA because of the amount of time you have had the item you will not legally be entitled to a full refund - you will be entitled to a repair at no cost to yourself, replacement (like-for-like) or partial refund, for which the retailer has the right to choose. If they do offer you a full refund that's fine but it will only be a gesture of goodwill.

    EDIT: Write to Comet H/O and send via recorded delivery and state in your letter that you expect a written response within so many working days, 10 would be reasonable.

  • Just to update you on the DVD recorder which has developed the same fault 3 times in 18 months.
    Thanks to all of you who took the time to offer advice. Firstly, can I clarify that the fault is that the machine can not read the loaded discs. It loads without a problem, but gives an error message of inappropriate disc found. This is with prerecorded and blank discs. Comet have inspected the machine and agree that this is a recurrent fault. It is in no way user error or misuse.

    After taking all the advice, I have contacted head office with a letter from trading standards. However, they still insist that I pay for the repair. My husband has been into the local store, handing out leaflets 3 times, and has been threatened by the manager. We have never been abusive, but have made quiet protests telling the truth. The last time my husband went into the store, the manager lost it and snatched the leaflets out of customers hands. Very professional!!

    However, we are at stale-mate. Where do we go from here? Any further ideas will be greatfully received. Thanks.:confused:
