HELP!Debt company chasing me 4 debt i've paid a yr ago and they'r sending me 2 court!

I can'e believe this is my 1st post.....:mad:

A debt company called avance group keeps sending me letters on a debt i've cleared last yr-even be4 the very 1st letter they sent me. I'd been thr this then, sent them emails quote every info in and they promised i can ignore any letter afterwards-that was last Feb. And now they are sending me these crap letters again just this time they ask me to go to court.

God i'm shaking when typing these..

Letters always came on Sat and when i tried to call them there's always a voice mail!!!!!!!!!!!!!!!!!!!!!!!! I've left all my contact but they never call me bk!!!!!!

Now i've done enf with them i need someone's help to stop them doing this to me!!!!!!!!!!!If there's anyone who knows what can i do to stop their letters or maybe go to court so i can slap them in the face with all the reference and sue them for what they did to me I'll be very grateful.

PLZ help I can't stand it one more day.

    First things first:

    Have you got written proof of the debt being fully cleared?

    Who was the money originally owed to?
    SOA = Statement of Affairs (to find a SOA Calculator, google 'make sense of cards' & click on calculators tab > Statement of Affairs)

    Hi, and welcome.

    Whilst it's up to Avance to prove the debt it would be handy if you had written proof that you've cleared the debt, such as the last statement showing a zero balance.

    Who was the original debt with?

    Sorry ajaney, I've just realised I'm repeating what you've just posted.

    If you have such proof you can simply sit back and ignore them. Wait for a court summons if one ever arrives, defend it-we'll help you here, and turn up and show it to the judge. These DCAs are trying bullying and psychological tactics to frighten you into paying up.

    If you look through the sample letters there is one about making a complaint to a DCA when you don't owe the debt. You can input your bits and send it off by recorded delivery. DON'T sign the letter- just print your name at the bottom.

    Have you actually received a county court claim form or are they just threatening court action?

    It was Fedex -import duty came 40 days later than the actual goods--they do it all the time btw.

    i paid it thr online transfer on 10 Jan 2008 which is earlier than the 1st letter they gave me on 7 Feb. I don't even undersand why it's gone to avance in the first place. I've got the online transfer record printed out shows date and time when i did it. I don't know if this counts. I'll call Fedex 1st thing Monday morning to double check-although am pretty sure the money's gone thr them 9 month ago.

    They did stop sending me letters when I emailed them stated all the date,time,ref and they said they would go check with fedex and told me to ignore everything after.

    It is a threaten to court says i hv to pay be4 6 Oct- like always, letter came Sat morning leave you no time to call a solicitor or OFT.

    And the other thing is how can i stop this once and forever.

    How did you do the online transfer, was it through your bank account? If so I suggest you make sure the money was deducted from your account and keep a copy of this statement along with the reference details.

    To stop this once and for all you might have to wait for a County Court claim form and defend it using the above proof. Once again if it gets to that stage get back on here and you'll get help.

    It won't do any harm sending off the letter I gave the link for in the meantime.

    Have you checked your bank / card statement to ensure the money actually left your account. You can often look at past staements/transactions online.

    Did you get an emailed receipt from FED-EX

    (Now it's my turn to copy you, shinyhead lol!)

    I've found my bank statement and yes the money has been deducted prom my account on 10 Jan.
    But I havn't got any email or mail confirmation from Fedex. Do i have to get one from them or just the statement is ok?

    I'll wait and see what avance is up to coz i've had enf and they wrote in the letter the court summon will arrive shortly.

    Fedex received payment - that is all that matters.
    Avance are trying to collect a debt that has already been paid and they have been notified of this (numerous times).

    Don't bother phoning Avance again. Just send the letter that shinyhead has linked to and refer to the debt already having been paid to Fedex. They need to prove you owe a debt and if you have already paid it then obviously there is no debt owed. If they are stupid enough to take this to court, you might even get to see the judge chasing them along the corridor for wasting his time.

    Don't let this upset you too much. You have done everything you can to clear up the situation. Just keep all further communication in writing and if they ignore your leter, i'd contact trading standards for harrassing you.

    fedex called me today-dun't know if it is because my voice mail finally worked out..said because someone left the position my money was held there for a yr...but they'll pass the info to avance..cheers everyone
