Scratched discs

I've nearly always picked up my computer games 2nd hand, unless it is a real Triple A title I have to own.
A branch of CEX has opened in my town and I bought a game from them and the disc was scratched I did not notice this until a couple of weeks later.
I was wondering what my rights are when it comes to this, if I purchase a 2nd hand game from a retailer what are my rights in terms of taking the item back?

If it still works then there is no problem, you cant expect a second hand disk to be mint0

I've only ever had one disc which was damaged effect the game...
I don't expect the discs to be perfect, but I expect them to be playable.0 -

well since he bought the game at least 2 weeks ago i'd expect the shop has been open since then. From what he's said i don't think the scratches are affecting the game (he says he's only ever had one scratched disc that hasn't worked) so i'm lost as to where the real problem is. Also if he didn't notice the scratches when he bought it maybe they weren't there and it's been scratched once he had it... if it's a 360 game that's quite likely.Bought, not Brought0
