the ghost of yes car credit

Help! can any one here direct me to someone who can help with an old forgotten debt that has reared its ugly head again-summary follows
in 2004 i took a car on credit with YES CAR CREDIT obviously i defaulted on the agreement and they repo'd the car, when they called to make arrangements for me to pay the balance i made an offer then after a few weeks they stopped taking payments from my account ( i think this is because they went bust) nothing has happened since, no letters no calls, nothing(since early 2005) THEN today i received a call from a debt collection agency called GO, they said i have to pay all of the debt within 7 days or they will freeze my bank account and force me into bankruptcy - is this legal - am i still liable after this length of time, especially as they broke the payment agreement and then took no action, should i complain to the FSA?

    Firstly, the DCA cannot freeze your bank account as they have no access to it, they are just threatening you with bankruptcy to scare you so try not to worry too much as they do this kind of thing all the time.

    A debt only becomes statute barred after 6 years so while essentially yes you are still liable, firstly do not acknowledge the debt in anyway and write to them to ask them for a copy of the signed CCA you will have signed at the time of taking the loan, you will need to send this recorded delivery and they have I think 28 days to comply with your request, if they can't produce it then the debt is unenforceable and they can do nothing.

    Someone else will come along soon with a lot more experience in this than me, but try nt to worry

    sorry, DCA is Debt Collecting Agency and CCA is Consumer Credit Agreement

    Try this forum - they used to be called saynotoyes & were a crusade against this company! They changed their name to carcreditcomplaints after Yes went bust but the company you have been called by would seem to be Go Debt & there is a dedicated thread on this forum for GoDebt & there will be people who have been in the same boat as you.
