What is the legal position on non fault accidents, all wagon crashed into my car last week, it was parked at the time i have comp insurance, i have now been told i need to chase the insurance company responsible for the wagon that hit me to claim my excess back. i can understand if it was my fault having to pay the excess. but why should i if it wasn't my fault and can prove it with witness photos and the wagon drivers admitance of blame.
i am just playing ping pong between the insurance company and drive assist and direct choice and the claims service. all on 0870 numbers of course.

Your excess is classed as an uninsured loss and it is up to you to recover it from the driver at fault.
If you only deal with the other driver's insurance company, they will pay to repair your vehicle and you will not have the excess to pay in the first place. It is only when you claim off your own insurers that it comes into play.
If you have your vehicle repaired through your own insurers, you will have to send proof to the fault driver's insurers of the loss of the excess anyway so you may as well write to them when you have that.0 -
I have a completed form from him, in spanish, which i have forwarded to my insruacne, it just frustrates me that i have spent over 3 hours on the phone to 0870 numbers getting know where, i am now 250 out of pocket for parking in my office car park and a wagon driver getting lost, i have now been told by direct choice that i can take out their legal cover and they will chase it for me but if i had accepted a hire car from drive assist they would chse it for me, so i am completely lost and p/o with the whole job,
though i have found if you go the the fsa web site you can get the georgaphic numbers for most fsa regulated companies.The futures bright the future is Ginger0
