  • i was involved in an accident, some friends were in a car behind me, the police at the scene told us that my friends could not be witnesses as they could be biased

    strange... it is an offence to witness an accident and not give a statement.. although this is rarely acted on...but anyone who sees an incident occurring is de facto a witness to that event..what they probably meant was that their evidence may be disallowed in court, or that counsel may ask that their evidence be ruled inadmissible due to the possibility of bias....

    I think as one of the witnesses was the headmaster on duty should be relied upon as a fine witness. I would be very very surprised if he was discounted because he is wifes boss.

    Kind of getting off the point here though. Is there an ombudsman I Can get involved?

    You could refer the case to the Financial Ombudsman but if you have not exhausted the insurer's official complaints process they will just pass it straight back to the insurer. So my advice remains the same - call your insurer and ask them to explain in specific terms why the matter has not been settled. If the response is unsatisfactory then raise a formal complaint.
