I know what you're saying, Jaffa, but I don't think it's as clear-cut as that.

For the sake of argument, we'll ignore the issue that two people might have both copied the text from a third source (like a manufacturer or internet seller's website), which happens often. In any other situation, I think the auction text would have to be 'significantly original' for ebay to be justified in enforcing any supposed IP rights you have over the text. By that, I mean a few sentences describing the item in a generic way, a list of specifications, or the rehashing of a description from somewhere else should not count as work that you can claim "ownership" of.

Now I have no idea how ebay judge these situations, but if I didn't know better, I'd expect them to apply some common sense here. As it is, they probably flip a coin or something , but I'm sure a decision is made on a case by case basis and depends on the originality of the auction text.

personally I host my own pictures at pipex (my ISP), if someone copies an auction (as someone did a couple of weeks ago) i just change the images for hardcore pornography,

gets them booted fairly quickly :-)
