Hi have just been to a redetermination hearing yesterday after receiving a CCJ for only ONE missed payment on my Egg Loan. Drydens of course as :T ever were after a charging order yesterday as the Court had made the CCJ for £5 per month it would take me 250 years to pay of my debt. The Judge was actually very good and told me I should have sent in a full defence to the CCJ as I pointed out the Terms and Conditions had not been followed by Egg. Luckily I had juggled figures around and said I would pay it off in 27 years making the payment £50 Drydens were furious but the Judge has gone in my favour. Unfortunately, it has drawn Eggs attention to the Arrangement through Payplan for £1 a month for the credit card - they had sent me a review form and I had upped it t6o £5 per month but they have now sent it to the devil Drydens. When I send my monthly amounts to Drydens for the Loan I always address it to Drydens Debt Collection Agency (THEY HATE IT) After all that waffling my question is that I need to know where I can obtain the proof/evidence that Drydens have bought the debt from Egg. Egg have told me on quite a few occasions that when it goes to Drydens it has been passed to Drydens and they (Egg) no longer hold the debt. I have heard that Drydens buy these debts at between 10% and 40% and then go "househunting". I am going to try and find a good solicitor as the first one for the loan was absolutely useless by saying "you have no defence you owe the money you might lose your house". All my other creditors (so far) have been satisfied with reduced payments but like drydens say we want security. I have obtained my file from Egg and they have always been aware that I am on benefits yet they continued to put up my limit. They also fudged the figures to make the computer "says yes" by putting that I have 50 yes fifty :rotfl: children!!!!??? b y hell. Anyone have any ideas!!??

Have you tried requesting a copy of the credit agreement? If they are unable to produce it, the debt may be unenforcable. While requesting the agreement, you can ask for a statement of account and notice of assignment. I believe this is the document that shows if they have been given permission to collect the debt - not sure if it states whether they have bought it though.

I have tried writing to Drydens but they flatly refuse to enter into any correspondence with me. With the loan business I had known nothing about being taken to Court until I had a letter from Drydens who, when I rang them, were very aggressive, abusive and said that all the money NOW (7 days from the date of their letter posted at Christmas) or a Charging Order. As far as the Egg Credit Card debt goes I'm not sure what to put in as a Defence when I file acknowledgement of service? I have a copy of the credit agreement when I first had the credit card (2000) and there is a copy in eggs file that I requested under the Freedom of Information Act - I did try writing to Drydens for the same information but they said that as Solicitors they (and their clients were exempt from giving this information? as there was a court action taking place - I thought that only applied to criminal court but I'm not sure? Did Drydens give you this information about CCA requests in writing or over the phone? I'm betting they wouldn't put that in writing - if they did and it went to court, the judge should definately be made aware of this. Probably also Trading Standards and the Information Commissioners Office.
Does the CCA from Egg have the required prescribed terms?
For the credit card, it should state:B Repayments
A term stating how the debtor is to discharge his obligations under the agreement to make the repayments, which may be expressed by reference to a combination of any of the following-
(a) Number of repayments;
(b) Amount of repayments;
(c) Frequency and timing of repayments;
(d) Dates of repayments;
(e) The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable.
C Rate of interest
A term stating the rate of interest to be applied to the credit issued under the agreement
D Credit limit

They have not supplied a true copy of CCA Egg have only supplied through me requesting a copy of my file under the freedom of information act a copy taken from a computer screen really tiny writing. They also cannot provide copies of Default Notices only a small computer screen stating that one had been sent. I did have an agreement with them through Payplan - an automatic review card came through after six months which I filled in increasing my payments from £1 to £5. Unfortunately, after the Judge requested an adjournment at the hearing as he couldnt understand why egg would accept £1 for the credit card and not for the loan when they are in the same address - this brought it to their attention and, of course, I was not surprised when Oh Drydens all of a sudden had the debt all before the date of the second hearing. Looking at my file there was a flurry of activity exactly on the day the Order for the Adjournment came through. Thanks for the info I will send of the official request for a true copy and see what happens.:eek:0

The answer to your question is that Drydens are not debt purchasers. They are a firm of Solicitors who specialise in Debt collection. In reality, there are probably very few solicitors working there, the work will be handled by a load of unqualified staff, but they are not the usual sharks and do act on instructions from the lender rather than making up their own rules0

Drydens were unable to give me a copy of original agreement, and the first letter made it clear they were going for a charging order, the CCJ from Northhampton was a joke, obviously Drydens know how to manipulate the system in their favour, and exclude any joint debts. Eventually after 1 month after my request i received a copy from Nationwide, after the debt was cleared. My own solicitor told me never to talk to drydens and certainly not disclose to them my house was already sold.
Good luck to you all in your dealings with this company, get sound advice but make life difficult for them at every turn, they will have no thought for you, do I have any sympathy for poor credit crunch jobless bankers? hand them all over. even on the day I threw in the towel and went to Payplan, I was offered more and more money when I informed my creditors of my problems.0
