HELP! possible default applied to my fiances account

I'm sorry if this is in the wrong forum but i need help urgently.

Here is a post of mine from the 26/08/08:

"My fiance and I have a joint account which we use regulary and she also has an IPC account with a £700 overdraft where she is £650 overdrawn. This account hasn't been used for a while as all our bills come off the joint account.

On saturday my fiance recieved a phonecall from the RBS, out of the blue, regarding her IPC account, demanding that she make a payment to clear the balance. right there and then. My fiance tried to explain that we copuldnt possible come up with all that money on the spot but the rep wouldnt have any of it. His tone was very aggressive and without compassion to the extent he had my fiance in tears. He said that if a payment wasnt made today (he suggested using a credit card or a loan from a friend) there would be a default filed against her name and it would effect her credit rating.
I told my fiance, while she was still on the phone, to tell the man we would phone RBS ourselves to sort out the matter as the phoncall seemed too absurd to be legitimate.

We have since found out from RBS that the phoncall was genuine but they have appologised for the manner it was conducted.
Apparently, so they told us today, RBS have every right to file a default against my fiance as she has breached her contract by not depositing money regularly into her account.
They admitted the rep from the first phonecalll should have accepted a smaller payment and couldn't explain why he was asking for the full amount.
They've said we have to deposit around £60 p/m into the account to keep everything above board.


Any comments on this disappointing show of customer service would be appreciated."

We have since setup a s/o (or d/d) for the £60pm with RBS but here is my new predicament:

"HELP!

Even though we have been paying the amount RBS requested it looks as if a default has been put against my fiance's account.

I called RBS yesterday to cancel a standing order that was due to come out today as I wont have the funds until friday. RBS said they couldnt cancel the s/o and put me through to the review(sales) team who then suggested I take out a small loan to cover the s/o and also pay off my £500 o/d in the one (foul) swipe.
Normally I wouldn't have dreamt of entertaining a RBS loan but since i really didnt want to be charged £60 for the privilege of RBS paying my s/o I decided to go ahead with it.
The review(sales) assistant called me back later, after she processed the loan, to tell me my application had been declined.
Obviously this never happens, unless your credit history is completely keek, as they are desperate for people to borrow more money. The girl asked me if I had been missing any payments on any loans etc I had: the answer was a big fat NO.

It wasn't untill later when I was telling my fiance about the loan rejection when she reminded me of the problem we had with our account and the threat of a default being placed on it.

She will be going into the bank today to find out exactly whats up with the account but I was wondering if anyone here could give us some pointers as to our rights etc regarding this possible default"

    My fiance called our RBS branch just now to arrange a meeting with the manager but she was told there was nothing that they could do. They said that even if there was a default applied to her account they couldnt actually check to see if it was there never mind remove it. !!!!!!??????????
    They said that they could apply a wee note to say everything had been taken care off but it wouldn't actually affect our credit rating for another 3-6 MONTHS.

    This is unbelievable. How do they get away with this? What the hell can we do?

    I've been told on another forum that our loan refusal may be due to the banks limiting loans to no one but the best debtors due to the "crunch".

    You need to actually check your fiance's credit file first of all and see exactly what is on there.

    You don't actually know for sure whether RBS have applied a default or not so until you know for definate, there is no point getting mad at them.

    Not looked at overdrafts before.
    Are you currently reclaiming charges from this account? If you are then they can't issue a default as the account was in dispute. Did you receive a default notice from them?

    Yes we have a court case stayed regarding bank charges for the account.
    No, we never recieved any written notice, the first we heard about it was through an abusive phonecall described in my first post.

    As Beanie says, you need to make sure the default is on your credit file. I'd apply to each of the 3 CRA's for a copy (£2 each) just to make sure you know how everything stands.

    Check you are listed as being on the electoral roll at that address as well as checking that the addresses are correct.

    I've just checked my credit report and everything seems fine.
    The account in question is my fiance's however.

    A point of note: My new build house isn't on the electoral role yet, will this have an adverse effect to my credit rating?

    Yes as they can't verify the house exsists - it's going to effect things. Get the report from all 3 agencies - for both of you. Not being on the electoral roll won't help, neither will being in a new build which on paper doesn't exist yet (been there done that TWICE) so there might not be anything obvious on the reports, it's definitely too early to assume it's this account being placed in default.

    Thanks for the replies folks.

    Ive checked with Equifax, what are the two other companies?

    With regards to the electoral role: I really hope this is the problem as having a default would be a nightmare. I pay council tax(or will one my overpayments to the council for my last house have been used up to pay my current monthly bill) does this mean i'm registered with them? Sorry for being a noob!
