Your "buyer" sounds like a grade A T*@T and I would have sod all to do with him. I hope that you manage to get a buyer and move, but I wouldn't have anything to do with this loser. I wiolu tell him to do one but thats just me I guess.

I was reading this thread with growing incredulity. Any solicitor knows this, surely, so there's no way the vendors got advice from their solicitor to cancel the cheque.
My advice to the vendors, incidentally, is that this is a terrible time to be straining every muscle to be trading up buy a new place. So, I would just abandon the whole thing.
In any case, even if you want to proceed at the moment, I would just put this sale on hold until you are in a position to buy a new place at an equally knocked-down price to your own. After all, the whole purpose of this transaction is to move to a better house, not just to sell your own.No reliance should be placed on the above! Absolutely none, do you hear?0 -

The truth is house prices are falling every month and while I wouldn't like to be gazundered and would tell him to stick it, do you think you would achieve the same sale price (with or without £5000) if you put your house on the market today?
Whilst that is probably true, the OP is buying a new place at £50k over his original budget. There's no point in selling just for the sake of selling. The idea is to find a better house.No reliance should be placed on the above! Absolutely none, do you hear?0 -
We are not selling for the sake of selling, and the house we are buying is a much better house for what we need, currently there are five of us, but when we move, there will be seven, so we need a bigger property, as my mother and niece are moving in with us. This is the end of a long chain of events, we had sold previously, but as the property we were then buying needed a charity evaluation everything was delayed and our buyer pulled out, then with this buyer the house we were buying was taken off the market after valuations etc had been done. That house was a lot cheaper than the one we are currently buying, but it needed extensive work done on it, the one we are buying needs nothing done, so whilst it is much more expensive, we won't have the outlay we would have had.
So it isn't £50K over our budget, is £50K more than the previous property.
Yes, we are going to pay him off, my mother has a Cafcass appointment regarding retaining residency of my 7 year old niece on 5th November, her health has been quite bad this year, and her fears are that due to that they won't think she is capable of taking care of her, if her and my niece are living with us, myself and my partner, who both work for Childrens Services and have three of our own come into play. If she is returned to her mother, who is currently 'sofa surfing' and on drugs, she will have no life, or she could end up in care.
There is a far bigger picture to this than just the finance side of things.
So, as much as I object to giving this bully one brass farthing, I don't see we actually have a choice as things currently stand.0 -
And, no, I wouldn't do this the the people we are buying from, who are extremely nice and have this morning, after hearing of our situation, offered to give 'us' £1000 on completion as an act of goodwill, which has restored my faith in human nature.
We didn't ask for it btw, and they know we wouldn't pull out under any circumstances as they are fully aware of our situation.
