Debenhams Visa card

I currently have a debenhams store card. Whilst I was shopping at the weekend in Debenhams, they offered to upgrade me to their new Visa card, explaining that their long term plan is to gradually change all store cards to Visa cards. In actual fact, the "upgrade" was simply a new card application (unknown to me) with credit check. I did not authorise this, and was somewhat annoyed when my application was declined. I have now been given a leaflet that explains how to appeal to GE Capital (who run the Debenhams card) to find out why I was declined. In this leaflet, it says I must pay a £10 fee "as required by the Data Protection Legislation". Can they legally charge me this fee?? It seems like a scam to me!

GE Capital would not act illegally so you may assume that a fee of £10 for information of this type is OK...0
