Incapacity Medical - Disability Premium

I received a letter this past week to say that I had passed my incapacity medical on the grounds of my mental health and for the next year I don't have to send sick notes in etc which is a weight off my shoulders and I can concentrate on getting myself to a good stage in my life.

Now my question - people have been mentioning that I should be getting the disability premium on income support now due to passing this and been declared unfit for work, I've never heard of it before but is this true?

I get income support rather than incapacity due to not paying enough NI contributions.

P.S. I don't get DLA yet, have only just claimed so they are looking into it.

  • My partner was told you are eligible for this after 12 months sickness benefit has been received and it is added automatically to your money, however ours werent and had to request it.

    Another premium to enquire about is an age premium my OH gets this as he is 29, he didnt need to wait 12 months to get this.

    You dont get the age related premium with Income Support due to Incapacity but you do with Incapacity Benefit.

    It's really confusing isn't it? My husband doesn't work due to looking after me at the moment so money is tight but we do manage but I didn't even know I could apply for DLA until my psychiatrist told me.
  • Thanks for raising this. I always assumed you had to be on high or middle rate care to receive this.
    But, I rang the DWP this am to query it. (I receive high rate mobility and lower care). The lady on the phone wasn't sure either; as I have been receiving benefits for a number of years - they are checking and when they come back I'll let you know the result.

    I have never heard of this, i will bring this up at the job centre my OH had to give up work last July because he has 2 permanent disabilities and has been getting Incapacity Ben since Sept 2007. He doesn't get DLA as we got turned down (even at Tribunal) despite every Doctor apart from the one at the Tribunal who thought one of the disabilities was a leg disorder when it is in fact an inner ear disorder saying they can't understand how they didn't say yes to my OH from the start! We are now about to reapply again but i just wondered what this disability premium was and if it is just for people on DLA? My OH was signed off for 5 years when he went for his Incap medical about 6 months ago.

    We are getting the age premium (I think). My OH gets more a week than Incap long term states it should be and we get Income support.

    Not sure if this will work but this is a pdf link on the jobcentre plus website showing all benefits and rates. We get the incap age premium paid ontop of income support due to having to claim IS after emplaoyers ssp expired they didnt want us to wait any longer to get everything up and running.

    If this does not woork goto JCP website not DWP then go on customers home, disabled people and carers, financial help then click incap, to the right of can i claim incap there is a pdf link with pages of rates for each benefit. HTH.

    Thanks i just looked at this it is helpfull as it states all the benefits but i doesn't state what they class as a disability, does anybody know if it has to be given only when DLA is present?
