landlord and Letting agent Problems...Urgent

to be brief, i am owed rent for Jul, Aug, Sep, my tenants paid cash to the letting agent (private) who held onto the money even though constantly promising me he will forward it to me. He during this time has fallen on bad times due to being wiped out financially becuase of someone stealing money from him. He was financially on his knees and constatly for those months kept telling me "i am trying to give u the money etc" he kept accepting money from the tenants promising them he will pass it to me. This hasn't happened and now a insolvancy consultant has contacted me to provide evidence to show how much he owes me.
I am confused as can the tenants or me sue him? as he was not be honest about his situation and keep taking money from the tenants without passing it on.
and more to the point is there anypoint taking legal action he owes me over £1000 pounds but suing him may cost a lot???

If your letting agent is/was a member of ARLA or the NAEA your money should be protected.0

The words 'private' and 'cash' make me suspect he wasn't

OP- you employed the agent, not your tenants. It is up to you to chase him for your missing money, not them.
Get your tenants to pay you directly from now on.0 -

just checked... on the website it says he is NAEA member, i rang NAEA and they never heard of the address or the letting company name.0

i would report to police asap!
also contact the tenant, to arrange direct payments.Long time away from MSE, been dealing real life stuff..

if his company has been put into insolvency there is no point suing him.
it sounds like he was trading whilst insolvent, which is potentially criminal offence, you could try reporting him to the DTI or whatever it is called now. won't make you any more likely to get your money back but at least there is a chance he will get some comeuppance.0 -

They REALLY don't like it if someone is using their logo 'unofficially'. Might be worth reporting him to them. I'd imagine that's a Trading Standards issue too.0
