Hello, My husband will be going into hospital soon to have major surgery, we
dont know how long he will be off work for. He is 61, i am 57, i work 15.5
hours a week earning £100 a week. His employer does not pay sick pay, so
will he be able to claim some benefits, does he need a doctors note. Should
he have paid national insurance contributions, cos he hasnt much, being self
employed for years. Does it matter that i work.
Hope someone can answer my queries..Thankyou

he should have been paying regular class 2 (self employed NI)?
unless does he have small earnings exception certificate?
he really needs to get down to the benefit office to get all his details checked. He should have been paying NI though, because he legally has to if he is Self employed unless he has small earnings exception.the only debt left now is on credit cards! The evil loan has gone!! :j:j0 -
The OP says her husband is employed. If he is earning at least £90pw, then SSP should be payable for a max of 28 weeks at the weekly rate of £75.40.0

but she was saying that her husband hadnt really paid any NI because he was self employed for years, and if he has only recently become employed, it wont count if he is claiming benefits as they would look at 2/3 tax years ago for benefit purposesthe only debt left now is on credit cards! The evil loan has gone!! :j:j0

Entitlement to SSP paid by the emloyer must be established first, before any IB or IS claims are considered.
If he was S/E in the past and has not paid any/enough NIC, then he needs to sort that out with HMRC.0 -

Hi, Thanks for your replys
He has found out his employer will pay the statutory sick pay.
I earn approx £100 per week, so will he be able to claim any benefits
I will also have to take unpaid leave from my job to care for him when he comes out of hospital0
