Hi everyone, finally received Judgment Order from the court today which says
'Adjourned generally with liberty to restore', I think that means I have to carry on paying the amount I have been paying, unless I default on these payments they cannot take me back to court.
Not sure what my next step should be, I dont mind paying the 9.75pm but they are now charging me interest, I have never seen a statement from HFO Services (DCA), I also think they are still charging me for court cost, which they shouldnt be.
As far as Im aware they are unable to get a copy of the CCA from the original creditors, Citi Card.
So should I be asking for up to date statements and also request a copy of CCA, if they fail to supply one, what next.:rolleyes:

From what people have said on the thread, if they've not provided the CCA in the time-frame then the account is in dispute and they should not be adding interest now. I'm supposing that there might be a template letter somewhere for you to send to them?

Something else to think about, if they can't provide a copy of the signed CCA, have they ever shown you any proof that they own or are authorised to chase the debt?
If they can't prove they own the debt it doesn't matter whether you owe the money or not.0 -
Additionally, people are frequently bullied into paying debt that they might not necessarily have to pay.
I've seen one post today for example where someone's brother or uncle was bullied into paying a debt he didn't own.
Fear makes us do silly things sometimes - and it's hard to fathom if they're right when they talk to us the way they do. It's scary and if you don't know your rights then they have you over a barrel. I've learnt a lot these past few days.
It's a morality thing I think you need to get over. You've paid these people consistently and still they're mucking the way for you w/regards to adding interest etc. It truly is as though they're trying to make your circumstances financially worse than they already are (which of course they are). It's upto you at the end of the day. If your credit rating isn't important to you (it isnt to me anymore - having a bad one stops me getting more!) then go on ahead with it. You owe them nothing. HFO did have a copy of a letter that was apparently sent to me a few years ago from Citi Card saying HFO were taking over the debt, I dont remember receiving it but that's not to say I didn't. So I soppose I should ask for a copy of the CCA, almost sure that cant supply one because when I was in court they said they had requested one from Citi Card and it was in the process of being sent however, it had taken a year for this case to get to court, I guess they thought I would pay up before the hearing, so I would imagine if there was a CCA to be had they would have had it by now, surely it wouldn't take over a year to get it.
Do I send the letter recorded and enclose a 1 pound postal order?larry470 -
Ive tried looking for a template letter requesting CCA but cant seem to locate one. I know they are around, can someone point me in the right direction please.:rolleyes:larry470
