  • would charging order only apply if/when a CCJ was granted- assumning there wasnt a good enough defence to get any summons dismissed?

    if i was a creditor, and it got to court stage, i would be going in heavy-
    a (genuine) debt is a debt.. wouldnt want person owing me to wriggle out.
    Long time away from MSE, been dealing real life stuff..

    Yes, the claimant would still need judgment but wouldnt have to wait for any instalment order to default before they could apply for a charging order x

    I don't see the problem with this. Why shouldn't your house be in danger if you can't pay your debts?

    Seems pretty sensible to me. Something had to change with the crazy amount of debt out there. I wouldn't be surprised to see bankruptcy toughened up a bit as well. Especially now there's no stigma or shame over debt.

    What a cheek! The PM saying he is too busy. Who does he think he is? Can anyone answer this please? If the debts are in one persons name and the house is in joint names can they make you sell your house? My husband wouldn't agree to that - end of story! They're not his debts but he does own half of the house.

  • Ixwood the banks and lenders aren't blameless for this mess as well. They were throwing credit at people a few years back with the minimum of fuss. I'm sure most people would be hesitant taking out "unsecured credit" if they were made aware that they could ultimately lose their homes if they experienced repayment problems.

    That is the whole point of them being "unsecured" which is why you pay a higher rate for the Banks extra risk.

    So you agree it is fine for a bank to profit more by a higher rate if all goes well, which is fare enough as that was the agreemant, but should still be able to secure the loan on property if it goes wrong, which was not part of the agreemant, even though accross the board that possibilaty of loss has been factored into the rates?

    we have 207 signature, but what has surprised me today there have been over 2000 views on this thread so far, are the rest of 1800 who viewed not in debt thus cannot see our dilema?

    human nature i guess ive learned so far in my debt journey is that if it dont affect them it dont matter,

    come on guys give us a bit of support - one day i will be debt free but the lessons im learning along the route is very humbling and my compassion has grown no end, as i have seen other people in far more serious situations than myself.

    However, having faced repossession of my house this year, and still being monitored by my lovely mortgage company, at least i avoided the courts with me being pro active and now have to deal with unsecured creditors only

    my debts are my responsiblity i know before anyone shouts at me,lol

    peoples circumstances change and loss of job,illness, other factors come into and those who have not the experience count yourselves very lucky - i envy you but at the same time , looking back on this year, im glad ive learnt what ive learnt from my journey, i believe its made me a stronger and more compassionate person towards other human beings
