    Hmm, but SPML (Capstone) aren't offering remortgages anymore and haven't done so for a good 6 months or so. So when the current deal expires you can either go on there Libor rate or remortgage with a different lender.

    Are they now offering remortgages?

    After getting the letter saying arrears due from 13mts ago I sent them a letter asking them to prove it.

    Today I got another letter saying the arrears had doubled because they also found an unpaid dd from Dec 2006. I paid that by cheque and can prove it!

    Sent them another prove it letter.

    This is getting beyond a joke !

    Yes, I wouldn't be finding it funny now. That is a bit close to harassment. Their financial records must be in a complete mess. You might want to start setting deadlines by which they have to reply to you, eg within 14 days.

    Hi

    As I read in the Times the other week that the Lehman administrators were looking to sell SPML/CAP I reckon they are being audited and now trying to rectify all their mistakes.
    Just my thoughts.

    This thread might suggest what's behind the delays I've been facing while trying to buy a run-down buy-to-let repossession. The title deeds give PML as the mortgage lender.

    I made a cash offer over a month ago, it took two and a half weeks before it was rejected, EA said the bank would accept £5k more and get back to me the next day but that was two weeks ago and still no information. Also still no HIP after more than a week. Although this has been annoying for me the delay must be worse for the person whose property was repossessed.

    It seems like the bank repossessed a property and hasn't been able to process even a cash offer matching what they've asked for.

    I wonder if this point will make sense for anyone whose home has been repossessed - mortgagees are entitled to redress if the bank hasn't tried to get the best price, but there's no chance of getting the best price in falling markets if the bank is unable to put resources straightaway into selling. This property should have been sold at last month's price when a buyer was available - unfortunately I can't wait forever, maybe another buyer will come along after me (offering this month's price) or maybe the next stop will be the auction house.

    To all of you that are experiencing poor service, you might want to add the 6 key principles that lay at the heart of FSA mortgage regulation (entitled the 6 Treating Customers Fairly Outcomes);

    Number 1 outcome is;

    "Consumers can be confident that they are dealing with firms where the fair treatment of customers is CENTRAL to the corporate culture"

    Always send your letters recorded / special delivery, and always do one copy to the chief compliance officer where you feel you have experienced poor outcomes.

    Just a thought, but did they parcel up the mortgage, chop the parcel into pieces and are now unable to find out who they actually sold the pieces to.

    Reason Why letters or Suitability letters are not compulsary as confirmed by the FSA. Advisers choose to issue them to assist the customer in explaining their reccomendation of the mortgage.

    Correctly identified, KFI's & IDD's are.

    Hi

    Have just had another phone call to say I am now £1200 in arrears!!!!!!!!!!!!!
    Not being in the best of moods I was not very nice to te girl and told her that is completly wrong. She says that aside from oter arrears this months payment has not been paid!
    I told her that I have an agreement to pay by the 10th and payment went yesterday!
    She says that I need to sort the rest out.
    Told her I have sent aletter with dates of payments etc and they should check it out before continuing to harass me.
    She says the bank system has shown none payments for several people and they are correct and I owe them!
    I then got made and said no I bloody don't so she says ok well how about we cancel the agreement to pay by the 10th then!
    I then ask for her name she says no I say I want your name she finally gives it and still insists I owe them because when I paid by cash over the counter the bank have taken it back!!!!!!
    I tell her I didn't pay either of those payments by cash and they need to read the letter and check their facts before continuing to harass me or I will report them.
    She then says bye and hangs up!

    Sorry for the rant but this is really getting to me now.

    Who do I go to now?
