Voluntary Termination

Hi there!
I want to do a voluntary termination on a welcome car finance hire purchase. The bit about "taken reasonable care of the goods" on the agreement has me slightly worried though. If the car has no service history can they refuse to take it back even if it's in good working order?

  • Why not call them and request a definition of 'reasonable care' and examine it in conjunction with the original loan docs ? If the car is road-worthy (full MOT, taxed and insured) and you have repaired any damages etc then it should be classed as reasonable care.

    Remember, if they did not stipulate a service history was needed in the original documentation, they may be unable to enforce a request for one now.

    If you haven't kept to the recommended service intervals I should think they will have every right to doubt whether you have exercised 'reasonable care'. As a matter of interest, why didn't you have the car serviced? It is quite important, actually.
    I used to think that good grammar is important, but now I know that good wine is importanter.
  • I think what they will do is do an independant inspection of the car to determine what condition it is in. Call them up and ask for a definition of 'reasonable care' if it isn't explained in the terms and conditions.

  • When we terminated our car agreement, it didn't have any service history and no one mentioned it. To be honest, the person that came to collect the car was not from the finance company, but from the auction company that were going to sell the car. We just signed on the dotted line and they drove it off - no questions asked. Feel free to pm if you have any probs or questions.

    When I sent my car back to the finance company I was told that for every missed service they would charge the standard dealer rate of £180 per service.

    They would also charge for body repairs (anything over a parking / trolley dent) and any other items that would affect resale eg spare tyre, interior condition etc etc.
  • Can anyone help at all I am trying to return my car and have said that I would like to excercise my rights to a voluntary termination I have paid over half of the finance for the car and they have now written to me asking me to take it to a local auction and I may have a liability as my agreement is a Hire purchase unregulated agreement I do not know what this means and cannot find that statement anywhere on my agreement which is with Northridge finance what is my contractual liability ?? can anyone help ??

    Hi All,
    I am sending my car back under the V.T rules to welcome Finance today I had a guy come to do an inspection from the RAC on behalf of the finance company his findings were:-

    Stone chips to Front Bumper
    stone chips to Bonnet

    Scratch to nsr wing( This scratch was on the car when I originally purchased the car)

    I bought the car 2 yaers ago with 96,000 Miles on the clock it hass now done 113,000 MIles and the car is in better condition now that when I bought it.

    I have Full Audi service history wirth the car & surely a car with this mileage on it is expected to have this type of stone chip damage as i accepted it at 96,000 Miles with stone chip damage.

    The RA man asked me to sign for the damage which i refused to do so as I would be agreeing to paying the £500 to rectify the damage he quoted.

    They are having a laugh surely,

    Simon, might be worth giving nationaldebtline a call. They have a bit of details on their website about VT and should hopefully be able to advise you of what to do if you disagree with the £500 quote.

    Did you inform the car company of the scratch that was on it?

    The garage that I bought the car from is no longer trading But i do still have contact with the guy who originally owned the Garage as he is local guy who originally sourced the car for me and he is now a trader buying at auction for car dealers.

    I did call nationaldebtline and they did say that I had already officially V.T d the car but tey weer unsure about wear and tear guidlines,

    They are trying to shaft me big time here I just took some high res images of the supposed stone chips unbelievable I can hardly see them.

    I could possibly shaft them back as when I requested a copy of my credit agreement from them they sent me mine and someone elses agreement with all their personal details on iteek.gif

    I did call them weeks ago to tell them this and the guy went very silent on the phone & then said oh thanks for bringing it to our attention please post it back to us & we will refund your postage cost, I said yeah right oh I will loltongue2.gif

    I still have this copy which is not mine.

    Shaft them back deeper & harder I think comes to mind lolbiggrin.gif

    Any suggestions anyone ?
