income support / disability premium

i have just had a letter to say i have been awarded DLA both at lower rate (backdated to june) and as i am now entitled to the disability premium on income support....i was just wondering do you think IS will backdate the disability premium to when DLA has been awarded from or just starting from now?

  • just an update, off the phone to guy at IS and seems IS wont be backdating the disability premium at all :(

    It all depends on when you became eligible for the Disability Premium, as this is typically paid after 1 year of claiming.
    So for example if your DLA is backdated to June and say in August you became eligible for the DP then what they can (and should ) do is backdate it to when you became eligible say August.
  • ok im confused and think i have got it wrong....as far as i could make out recieving DLA entitled you to the disability premium or after 1 year of claiming. i didnt think it had to be both :confused:
    The disability premium
    If you are under 60, you may be able to get this premium if you or your partner are:
    • getting DLA
    • or getting Working Tax Credit where a disability or severe disability element is included in the award
    • or getting Attendance Allowance (AA) [Legislation (67)]
    • or getting Incapacity Benefit – long-term rate
    • or getting Severe Disablement Allowance (SDA)
    • or provided with an invalid carriage
    • or your higher-rate mobility component of DLA is being paid direct to Motability
    • or registered blind.
    If blindness ends, you will still get the payment for up to 28 weeks after you cease to be registered blind.

    You may also get the disability premium if you are accepted as being incapable of employment (or receiving Statutory Sick Pay) for at least 364 days (196 days in the case of terminal illness), including periods of incapacity separated by 8 weeks or less. A new 52 week linking rule was introduced from October 1998 for those who leave benefit to move into work but who subsequently return to benefit as incapacitated within 52 weeks. Periods during which you have been receiving Statutory Sick Pay (SSP) from your employer may count towards the 364 days.

  • I'm a bit confused here! I get LRC & LRM and I am on Income Support (they pay my mortgage interest) but as far as I know LRC & LRM don't get you a disability premium on IS, I thought that only happened if you got Middle Rate Care.

  • just found this also which makes it seem like you should...it doesnt say what rate of DLA you have to be getting.
    Who qualifies?

    You must be under 60 years of age. It does not matter if you have not paid national insurance contributions. If you or your partner receives incapacity benefit at the long-term rate, severe disablement allowance, (SDA) or disability living allowance (DLA) you should automatically qualify for the disability premium in your income support , income-based job seekers allowance, housing benefit or council tax benefit. If you do not receive DLA , SDA or incapacity benefit you will need to get sick notes from the doctor and be classed as incapable of work for 12 months (for more details see, how to claim). If you are claiming income support or JSA for your partner and it is your partner who is sick (and they don't receive DLA , SDA or incapacity benefit) then it may be advisable to change the claimant role to your partner- get further advice on this. You may still choose to sign on for national insurance credits if you are unemployed.

    you need MRC to get the severe disability premium which can be paid instead of carers allowance and is worth around £50 per week for a single person

    So am I right then ? (As in at LRM &LRC there is no disability premium for Income Support)
