Cheers, The games arrived today and I phoned Customer Services and for a while they told me it was a mistake in the warehouse and they did have them and would be sending one out to me. Soon after this though they changed their tune and told me it was a mistake ! Needless to say they will be getting the items returned and a snotty email from me.0

Received my GUS order this morning. No PSOne as usual. Spoke to their Internet Team Manager who confirmed it was a mistake, but a mistake they will not honour..as per their T&C....all BS. He said he didn't have any PSOnes anyway....BS once again i'm sure.
Got them to send me a returns pack...i do hate Mail Order....second time i've bought from Mail Order in my life...the first was the great Empire Stores fiasco....NEVER AGAIN!A shadowy flight into the dangerous world of a man who does not exist.

I just received my games also today. No console.
Does anyone know where we stand on this?
Can we do anything or are we left having to return them?
I received two emails when I placed the order and both say console and games.0 -
Regarding GUS then in theory you can do something, AND there is some hope, for example when Grattan mucked up on their description of Sonic Brushes (getting heads and toothbrush the wrong was round), the eventually bowed to pressure and supplied what was promised at the required price:

If you want to pursue then I suggest emailing them, with screenshots or printouts showing what you originally ordered and asking them to honour the original deal. Usual rules apply i.e. a contract has been formed when they shipped the goods and took payment.
They have accepted your order and did not notify you of any errors / changes so 8 from the T&Cs does not apply.

As a contract has been formed if they are unable/unwilling to fulfill the contract they entered in to, you will pursue them for "loss of bargain". Google for "loss of bargain" and contract for more info.
They cannot claim that the mistake was obvious as Dixons et al were offering a games bundle PSone for £14.99 (out of stock). FYI the following company still has the PSOne in stock:

got my games today.
think i will just send them back unless of course there is a chance that they will send us all a psone0 -
I managed to scam my money back from GUS.
I rang them up and told them I had not received the games ata ll. Told them that was sick of their service and wanted a refund.
Because they had messed up by not sending the console and then lost the games they gave an instant refund and put the games down as 'lost'
Therfore, got my own back by not paying anything and getting 3 PSone games.
