Halifax debits for fraudulent charge minimum payment by DD

Hi,
I saw a fraudulent transaction for £321.35 on my Halifax "One Card" and reported it to Halifax. They investigated and agreed; and they sent me new cards.
I normally don't use the "One Card" so it sits empty month after month (indeed, I had had a £5 credit sitting on it).
They credited my card the £321.35 amount on 2 Sept.
Then on 16 Sept they used Direct Debit to take the "minimum payment" of £6.32 from my Smile current account!
Do you know if this is in breach of the Direct Debit guarantee?

I suspect its an automated mistake, why not phone them up and query it?
You should have recieved a statement stating the amount they were going to claim and if so then you cant get your bank to refund the amount as you were informed in advance.
However I'm sure if you phone them up it will all get sorted out.0 -
The Halifax DD collection system is 'set in stone' once the statement is produced, and will collect whatever the statement says will be collected.
It seems Halifax have sorted the fraudulent transaction issue AFTER the August statement was produced, and so the DD was still collected.
Should they have taken it? Well, possibly not...but unless the £6.32 has caused you hardship (ie incurred you debit interest and/or fees & charges from Smile) then I'd let it drop personally.
If you have incurred costs as a result of the DD being claimed, then maybe a polite letter explaining the situation will produce some 'goodwill'?0
