Car accident. Claiming from person at fault...

I had to slam my brakes on when her car got slammed by the bus.
My knee has been iffy on and off since the op at the end of July.
Since slamming my brakes on the other day its been the size of a football.0 -
It's call emergency braking! You hurt yourself in a driving condition, no car hit you, get over it and GET REAL.
I've had 2 knee ligament operations on one knee, have driven when it was still tender, but capable to drive. I never would think that I would sue someone if I hurt the knee through emergency braking!0 -
My vote is also for the - perhaps your knee wasn't quite up to driving and it's just an unpleasant consequence of having to do an emergency stop. And if you did plough into the back of the bus and that caused you an injury, you would be deemed at fault for not stopping. Either way don't think there's any chance of getting any money out of it.
You have more chance of getting a bit of money trying this out http://uk.youtube.com/watch?v=JNbhwaLHuO4 but depends on whether you want to take the risk and can sleep at night afterwards

Do you think I can eject the contents of my stomach over your post? Because that's what I feel like doing.

As for me driving too close - there is a camera on that junction, so that comment could be dismissed easily.
At 30MPH, the safe distance is 28 yards or 84ft. Were you 84ft behind them? Somehow I doubt it.
And if you know you're still unfit, as you obviously are, you are not supposed to drive even though you get an all clear. Did the surgeon or GP carry out a medical examination after 3 weeks?0 -
I've yet to see a HGV driver at 28 yds.
However, I was doing about 15/20MPH as I was about to negotiate the 90 degree right hand turn and had eased off as I saw the directional light go out for our side of the junction.
And yes, the surgeon and dr have done medical exams on me since the op.
The surgeons was on week 6 and the GP's was on week 8. Both said I was fir to drive...0 -

I would worry about the gap you leave & let others worry about theirs.
Do not judge your driving by other peoples bad habits.
As its been said a load of times before, you have to be able to do an emergency stop to drive. As you had trouble you are very lucky you didn't go into them, you would have someone claiming on your insurance now.0 -
I was able to do an emergency stop. It's just hurting now.0

How about suing the person who advised you it was safe to drive?

(Just playing devil's advocate here).0 -
I had a knee op just over 8 weeks ago. I drove yesterday for the first time only a short distance and IT ached. I've done a little today also but that leg/foot is now more swollen. The DVLA guidelines when I last spoke to them after the op Mrs E mentioned were that I had to be able to perform an emergency stop as stated by others. Yes I can do one if I have to but like anything that uses muscles etc that haven't been used for a while it will hurt/ache. Hence tomorrow I won't drive as it needs a rest.
If you got stuck in a traffic jam and were stop starting all the time using your knee alot it'd become swollen & painful. In all honesty you can probably expect this problem to occur up to atleast 6 months post injury/surgery.0
