Quick question RE Tax Credits back pay, help please??

  • I did recieve money from Nov - July but as I didnt declare my partner moving back in they stopped it (from Nov) and we are now paying back all the overpayment.
    Somebody else on here in pretty much same situation as me had their award backdated too, so nothing to do with the fraud aspect as far as I can gather.
    Going to go back any see the lady in the CAB tomorrow and she what she advises...
    Anyone here work there any know why it's being refused? Obviously every case is different but the more I think about it, the more I think we should be entitled to it. I did ask for it to be taken off the bill what we owe but no joy?!?!

  • Request to speak to a manager if you get fobbed off again. If the manager tries to fob you off take their name and request the address to submit a written complaint. Also ask for an appeals form so that you can put your request in writing. You could always try requesting the claim be backdated further - ie to November 2007. I have seen this happen on the very odd occasion but due to the fraud it may be difficult. You dont get if you dont ask!

    Went to CAB, lady said she would write a letter on our behalf and advised me to call again and do as subsonic said above.
    Just rang them and explained the situation (again!) and was told almost straight away that I would be entitled to the 3 months backpay prior to July! So over the moon, if I get it would mean I can pay off my council tax and some of our other debts leaving us more each month to pay back the overpayment quicker. Its a win - win!
    Asked how long it would take and was told there was no set time period, to 'just leave it with them'....
    Anyone got any ideas how long I should have to wait?
    I feel so happy, i know what people mean now when they say a weight has been lifted!

  • The timescale is around 2-4 weeks depending on how busy TCO is. Right now I would say arounf 2-3 weeks.
  • Hi all! Back again, more questions....!!
    Just a bit confused to bw honest. Its been a couple of weeks since I was told about the backdating. Here is my current situation...
    Was told that I would get maximum backdating ie 93 days. Now I took this to mean I would get the weekly amount I receive now x 12 (approx 3 months) Is this correct??
    I have had 3 seperate payments into my bank, one for around £250, one for £300 and then a week later another £600 or thereabouts so about £1150 altogether. Obviously I am pleased with this as it means I can finally pay my council tax and arrears of CT but if I get £240 per week shouldn't I have received more in the region of £3179?? Eg, £240 x 52 / 365 x 93 (days)?
    Just a little confused, hope someone can shed some light on this.
    I rang after the first 2 payments and was told I had no more payments due then I rang again the next day as I thought it was wrong just getting £550 and was then told about the next payment of £600. The letter I got in the post shortly after the first payment said my claim had started from April!!Should I ring up again or leave it at that do you think?
    Obviously I am grateful with what I have recieved but cant make it to the CAB until next Tuesday morning so any advice from you guys and girls would be much appreciated.
