Dying with credit card debts.

If a senior citizen dies with no tangible assets (eg living alone in rented accommodation) but with considerable credit card debt, can her family be made to pay them off?

  • As long as the debts were in their name alone then the remaining relatives cannot be made to pay them, however if there is any money or assets in the estate then these will be used to repay creditors first. Some credit card companies do chase relatives for money on the off chance they will get some money so be warned!

    When you die your debts die with you. Go to your library or CAB and get the get booklet D49 "What to do after a death in England Wales." Lots of questions answered for nothing.

    debts don't die with you...
    if you have any estate then debts come out of the estate... only if there is no estate do the debts die.
  • I should have said personal debts that apply only to you. Yes, things are paid out of your estate, but that is normal practise. The main point is that being "next of kin" has no legal obligations. Debt is not a good word - it usually means (here at least) money that cannot be paid at this point in time.
